HomeMy WebLinkAboutordinance.council.052-79RECORD OF PROCEEDINGS 100 Leaves ORDINANCE NO. ~ (Series of 1979) AN ORDINANCE MODIFYING THE PLAN REVIEW AND BUILDING PERMIT FEES CONTAINED IN THE UNIFORM BUILDING CODE WHEREAS, the City Council wishes to modify the plan review and building permit fees contained in the Uniform Building Code for the benefit of the City of Aspen, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO: Section 1 That Section 303 of the 1976 Uniform Building Code is hereby repealed and reenacted to read as follows: Sec. 303.(a) Permit Fees. The fee for each permit shall be as set forth in Table No. 3-A. The determination of value or valuation under any of the pro- visions of this code shall be made by the building official. The value to be used in computing the building permit and building plan review fees shall be the total value of all construction work for which the permit is issued as well as all finish work, paint- ing, roofing, electrical, plumbing, heating, air conditioning, elevators, fire-extinguishing systems and any other permanent equipment. (b) Plan Review Fees. When a plan or other data is required to be submitted by Subsection (c) of Section 301, a plan review fee shall be paid at the time of submitting plans and specifica- tions for review. Said plan review fee shall be 65 percent of the building permit fee as shown in Table No. 3-A. Where plans are incomplete or changed so as to require addi- tional plan review, an additional plan review fee shall be charged at the rate shown in Table No. 3-A. (c) Expiration of Plan Review. Applications for which no permit is issued within 180 days following the date of application RECORD OF PROCEEDINGS 100 Leaves shall expire by limitation and plans and other data submitted for review may thereafter be returned to the applicant or destroyed by the building official. The building official may extend the time for action by the applicant for a period not exceeding 180 days upon request by the applicant showing that circumstances beyond the control of the applicant have prevented action from being taken. No application shall be extended more than once. In order to renew action on an application after expiration, the applicant shall resubmit plans and pay a new plan review fee. (d) Investigation Fees: Work Without a Permit. 1. Investi- gation. Whenever any work for which a permit is required by this code has been commenced without first obtaining said permit, a special investigation shall be made before a permit may be issued for such work. 2. Fee. An investigation fee, in addition to the permit fee, shall be collected whether or not a permit is then or subse- quently issued. The investigation fee shall be equal to the amount of the permit fee required by this code. The minimum in- vestigation fee shall be the same as the minimum fee set forth in Table No. 3-A. The payment of such investigation fee shall not exempt any person from compliance with all other provisions of this code nor from any penalty prescribed by law. (e) Fee Refunds. 1. The building official may authorize the refunding of any fee paid hereunder which was erroneously paid or collected. 2. The building official may authorize the refunding of not more than 80 percent of the permit fee paid when no work has been done under a permit issued in accordance with this code. 3. The building official may authorize the refunding of not more than 80 percent of the plan review fee paid when an applica- tion for a permit for which a plan review fee has been paid is withdrawn or cancelled before any plan reviewing is done. RECORD OF PROCEEDINGS 100 Leaves The building official shall not authorize the refunding of any fee paid except upon written application filed by the original permittee not later than 180 days after the date of fee payment. (f) Fee Waiver. The building official m ay authorize the waiver of any fee payable hereunder for construction under the Department of Energy and Community Services Administration "weatherization" program. Section 2 That Table No. 3-A, and reenacted to read as Table No. Total Valuation $1.00 to $500.00 $501.00 to $2,000.00 $2,001.00 to $25,000.00 $25,001.00 to $50,000.00 $50,001.00 to $100,000.00 $100,000.00 and up Building Permit Fees, is hereby repealed follows: 3-A, Building Permit Fees Fee $10.00 $10.00 for the first $500.00 plus $1.50 for each additional $100.00 or fraction thereof, to and including $2,000.00 $32.50 for the first $2,000.00 plus $6.00 for each additional $1,000.00 or fraction thereof, to and including $25,000.00 $170.50 for the first $25,000 plus $4.50 for each additional $1,000.00 or fraction thereof, to and including $50,000.00 $283.00 for the first $50,000.00 plus $3.00 for each additional $1,000.00 or fraction thereof, to and including $100,000.00 $433.00 for the first $100,000.00 plus $2.50 for each additional $1,000.00 or fraction thereof Other Inspections and Fees: Inspection outside of normal business (minimum charge -- two hours) hours $15.00/hr. Reinspection fee assessed under provisions of Section 304(f) Inspections for which no fee is specifically indicated Additional plan review required by changes, additions or revisions to approved plans (minimum charge -- one-half hour) $15.00 each $15.00/hr. $15.00/hr. RECORD OF PROCEEDINGS 100 Leaves Section 3 If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portions thereof. Section 4 A public hearing on the ordinance shall be held on the~7 of ~__, 1979, at 5:00 P.M. in the day City Council Chambers, Aspen City Hall, Aspen, Colorado.
