HomeMy WebLinkAboutordinance.council.070-79RECORD OF PROCEEDINGS 100 Leaves ORDINANCE NO. ~) (Series of 1979) AN ORDINANCE AMENDING SECTIONS 24-2.1(a) AND 24-3.2 OF THE ASPEN MUNICIPAL CODE BY THE ADDITION OF A NEW MHP (MOBILE HOME PARK) ZONE DISTRICT AND AMENDING SECTION 24-3.4 WITH THE ADOPTION OF AREA AND BULK REQUIREMENTS TO BE APPLIED IN THE MHP ZONE DISTRICT WHEREAS, the City Council desires to amend Section 24-3.2 and 24-3.4 of the Aspen Municipal Code by the addition of a new MHP (Mobile Home Park) zone district for the benefit of the City of Aspen, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO: Section 1 That Section 24-2.1(a) of the Aspen Municipal Code is hereby repealed and reenacted to read as follows: (a) In order to carry out the purposes of this chapter, the City of Aspen is hereby divided into the following zone dis- tricts: (1) R-6 (2) R-15 (3) R-15A (4) R-30 (5) R-40 (6) R/MF (7) MHP (8) RR (9) CC (10) C-1 (11) S/C/I (12) NC (13) O (14) L-1 (15) L-2 (16) CA (17) A (18) c (19) P (20) Pub (21) SPA (22) PUD (23) T (24) D (25) H Residential Residential Residential Residential Residential Residential/Multi-family Residential/Mobile Home Park Rural Residential Commercial Core Commercial Service/Commercial/Industrial Neighborhood Commercial Office Lodge Lodge Commercial Lodge Academic Conservation Park Public Specially Planned Area Planned Unit Development Transportation (Overlay) Drainage (Overlay) Historic (Overlay) RECORD OF PROCEEDINGS 100 Leaves Section 2 That Section 24-3.1(n) of the Aspen Municipal Code is hereby repealed and reenacted to read as follows: (n) Mobile home park. Any lot or portion thereof upon which sanitary facilities and individual utility connections are available for two (2) or more mobile homes. A mobile home park is distinct from individual mobile homes in that the park is operated under single management. Section 3 That Section 24-3.2 of the Aspen Municipal Code is hereby amended by the addition of a MHP (Mobile Home Park) zone district as follows: District: MHP Intention: To provide for the use of land for intensive long-term residential purposes, with customary accessory uses. Recreational and institutional uses customarily found in proximity to residential uses are included as conditional uses. (A MHP district shall be located in areas where the effect on surrounding property shall be minimized, where the health, safety and general welfare of MHP residents and others will be protected and where for MHP development.) Permitted Uses: Mobile home park; the topography is suitable accessory building or use. Conditional Uses: Same as Section 4 That Section 24-3.4 of the R-60 Aspen Municipal Code amended by the addition of a MHP (Mobile Home Park) with the following area and bulk requirements: (1) Minimum lot area (Square feet unless designated in acres (2) Minimum lot area per dwelling (Square feet unless designated in acres is hereby zone district 3,000 3,000 -2- RECORD OF PROCEEDINGS 100 Leaves 3) Minimum lot width (feet) 4) Minimum front yard (feet) 5) Minimum side yard (feet) (6) Minimum rear yard (feet) (7) Maximum height (feet) Administrative and service buildings Other structures (8) Minimum distance between principal and accessory building (9) Percent of open space require for building site (percentage) no requirement (10) External floor area ratio no requirement (11) Internal floor area ratio no requirement Section 4 If any section, subsection, sentence, 40 5 (exclud- ing hitch) 5 5 15 25 15 5 clause, phrase or por- tion of this ordinance is for any reason held invalid or unconsti- tutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining por- tions thereof.
