HomeMy WebLinkAboutordinance.council.086-79RECORD OF PROCEEDINGS 100 Leaves ORDINANCE NO. 7~9 (Series of ) AN ORDINANCE ESTABLISHING THE WHEELER OPERA HOUSE RENOVATION COMMISSION; DESCRIBING THE COMPOSITION OF THE COMMISSION; THE TERMS AND QUALIFICATIONS OF ITS MEMBERS; LISTING THE POWERS AND DUTIES OF THE COMMISSION; AND PRESCRIBING GENERAL RULES OF PROCEDURE FOR THE COMMISSION WHEREAS, the City Council desires to establish a temporary commission to offer recommendations to the City Council for the design, restoration, reconstruction, maintenance and operation of the Wheeler Opera House and to oversee the day-to-day activities of the restoration of the same. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO: Section 1. Establishment of Temporary Commission. There is hereby established the Wheeler Opera House Renova- tion Commission for the City of Aspen, Colorado, which commission shall act until the Wheeler Opera House is completely renovated (as determined by the City Council) or December 31, 1982, which- ever shall first occur. Nothing herein shall prevent the re- establishment of said commission on or after December 31, 1982, by appropriate action of the City Council. Section 2. Composition; Term; Qualifications. The Commission shall be constituted as follows: (a) The Wheeler Opera House Renovation Commission shall con- sist of seven (7) members appointed by the City Council and two (2) ex-officio members who shall be members of the City Council. (b) All appointments shall be for a period of one (1) year (or the balance of the term of the commission, whichever is less). There shall be no limitation upon the number of terms any member of the commission may serve. RECORD OF PROCEEDINGS 100 Leaves (c) All members of the colmmission shall serve at the pleasure of the City Council and may be removed by a majority vote thereof. (d) There shall be imposed no age or residency requirement for membership on the con~ission, nor shall candidates for appointment be required to be qualified electors. Section 3. Powers and Duties. The Wheeler Opera House Renovation Co~ission shall have the following powers and duties, all of which shall be exercised sub- ject to the laws of the state and municipality, with appropriate conditions and safeguards, and in accordance with the public interest and the most beneficial restoration of the Wheeler Opera House: (a) After review, to make recon~endations to the City Coun- cil relative to the design, restoration, reconstruction, maintenance and operation of the Wheeler Opera House, including but not limited to, advertising for and re- viewing bids for architectural and engineering services and subsequently recommending for City Council ratifica- tion the appropriate bid to be accepted and awarded. Section 4. Rules of Procedure, Generally. (a) A quorum to transact the business of the commission shall consist of four (4) members. (b) At its first meeting (which shall be called by the Mayor) the conu~ission shall elect a chairperson, vice- chairperson and secretary. 2 RECORD OF PROCEEDINGS 100 Leaves (c) The commission shall establish regular meetings and special meetings may be called by the chairperson or at the request of any two (2) members on at least twenty- four (24) hour written notice to each member of the com- mission, provided that a special meeting may be held on shorter notice if all members of the commission waive notice in writing. No business shall be transacted at any special meeting unless it has been stated in the notice of such meeting. (d) All regular and special meetings of the commission shall be open to the public except for executive (closed door) meetings as are permitted by law. Citizens shall have a reasonable opportunity to be heard and all minutes and other records of actions of the commission shall be made available to the public. (e) The commission shall adopt by-laws for the conduct of its business not inconsistent with this ordinance and shall adopt such rules of procedure as it deems neces- sary.
