AN ORDINANCE RATIFYING A WATER DELIVERY AND DITCH MAINTENANCE
AGREEMENT BETWEEN CASTLE CREEK HOMEOWNERS ASSOCIATION AND THE CITY
OF ASPEN PROVIDING FOR DELIVERY OF WATER TO THE CASTLE CREEK
HOMEOWNERS ASSOCIATION AND MAINTENANCE OF THE HOLDEN DITCH
WHEREAS, there has been submitted to the City Council a
proposed water delivery and ditch maintenance agreement between
the Castle Creek Homeowners Association and the City of Aspen,
and
WHEREAS, the Home Rule Charter of the City of Aspen,
Colorado, requires that all agreements for a term of one year or
more must be approved by ordinance,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ASPEN, COLORADO:
Section 1
That it does ratify an agreement between the Castle Creek
Homeowners Association and the City of Aspen attached hereto and
incorporated by this reference; and does further authorize the
Mayor on the effective date of this ordinance, to execute said
agreement on behalf of the City of Aspen.
Section 2
If any section, subsection, sentence~ clause, phrase or por-
tion of this ordinance is for any reason held invalid or unconsti-
tutional by any court of competent jurisdiction, such portion
shall be deemed a separate, distinct and independent provision and
such holding shall not affect the validity of the remaining por-
tions thereof.
