AN ORDINANCE RATIFYING A PURCHASE, SALE, AND OPTION
AGREEMENT BETWEEN THE CITY OF ASPEN AND ROBERT A. McCLUNG
AND DIANE M. McCLUNG PROVIDING FOR THE SALE OF UNIT ,Q_ OF
McARTHUR CONDOMINIUM BY THE CITY OF ASPEN TO ROBERT A. McCLUNG
AND DIANE M McCLUNG
WHEREAS, there has been submitted to the City Council a
proposed Purchase, Sale, and Option Agreement between the City of
Aspen and Robert A. McClung and Diane M. McClung, and
WHEREAS, the Home Rule Charter of the City of Aspen,
Colorado, requires that all such agreements must be approved by
ordinance,
NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ASPEN, COLORADO:
Section 1
That it does ratify a Purchase, Sale, and Option Agreement
between the City of Aspen and Robert A. McClung and Diane M.
McClung attached hereto and incorporated by this reference; and
does further authorize the Mayor on the effective date of this
ordinance, to execute said Purchase, Sale, and Option Agreement
and all other documents necessary to complete said sale on behalf
of the City of Aspen.
Section 2
If any section, subsection, sentence, clause~ phrase or por-
tion of this ordinance is for any reason held invalid or unconsti-
tutional by any court of competent jurisdiction such portion
shall be deemed a separate, distinct and independent provision and
such holding shall not affect the validity of the remaining por-
tions thereof.
Section 3
A public hearing on the ordinance shall be held on the~
day of ~__~ , 1980, at 5:00 P.M. in the
City Council Chambers, Aspen, Colorado.
