HomeMy WebLinkAboutordinance.council.042-80RECORD OF PROCEEDINGS 100 Leaves ORDINANCE NO. 4~..~ (Series of 1980) AN ORDINANCE IMPOSING A TEMPORARY MORATORIUM ON THE ERECTION, REMOVAL, CONSTRUCTION, RECONSTRUCTION, OR DEMOLITION OF STRUCTURES LOCATED WITHIN THE MAIN STREET HISTORIC DISTRICT WttEREAS, as a historic district by Series of 1977, said area Street Historic District"; a portion of the City of Aspen has been designated the provisions of Ordinance No. 60, is herein referred to as the "Main and WHEREAS, the erection, removal, construction, reconstruction, remodeling, or demolition of structures requires review and approval by the Historic Preservation Committee; and WHEREAS, the purpose of an historic district is to promote the educational, cultural, economic and general welfare of the public by preserving structures which have historic or architec- tural importance; and WHEREAS, the Historic Preservation Con~ission has advised the City Council that major revisions are necessary in the procedures of said district to preserve structures which have historic or architectural importance; and WHEREAS~ it is the specific finding of the City Council that a temporary moratorium need be instituted in order to preserve structures of historic and architectural importance pending review, consideration, and adoption of said proposed amendments to said llistoric District legislation; NOW, THEREFORE, BE IT ORDAINED BY CITY OF ASPEN, COLORADO: Section 1 The City of Aspen granted to the City by THE CITY COUNCIL OF THE hereby exercises those powers and rights the Constitution of the State of Colorado RECORD OF PROCEEDINGS 100 Leaves as a home rule charter city to promote the safety, health and general welfare of the City by imposing a temporary moratorium the erection, of structures said district on removal, construction~ reconstruction, or demolition located within the Main Street Historic District as is defined by Ordinance No. 60, Series of 1976. Said moratorium shall be for a period not to exceed from the effective date of this ordinance. Section 2 This temporary moratorium shall affect all property located within the corporate limits of six (6) months structures and the City of Aspen with respect to requests from property owners for the erection, removal, construction, reconstruction, or demolition of structures located within the Main Street Historic District; provided, how- ever, the moratorium shall not affect those requests, which at the time of the enactment of this ordinance on first reading, have been submitted to the City and with respect to which no final decision had been made by the City; and provided further, the moratorium shall not affect requests from property owners to remodel structures located within the Main Street Historic District. For the purpose of this section the "remodeling" shall mean and include an improvement or improvements to existing struc- tures not exceeding 20% of the current replacement cost of the structure. Section 3 If any section, subsection, sentence, clause, phrase or por- tion of this ordinance is for any reason held invalid or unconsti- tutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining por- tions thereof. 2 RECORD OF PROCEEDINGS 1 O0 Leaves Section 4 A public hearing on the ordinance shall be held on the ~ day of ~ , 1980, at 5:00 P.M. in the City Council Chambers, Aspen City Hall, Aspen, Colorado.
