HomeMy WebLinkAboutordinance.council.043-80RECORD OF PROCEEDINGS 100 Leaves ORDINANCE NO. 4~ (Series of 1980) AN ORDINANCE AMENDING ORDINANCE NO. 30, SERIES OF 1976, AND ORDINANCE NO. 38, SERIES OF 1978, AND ESTABLISHING A NEW FORMAT FOR SETTING ELECTRICAL RATES FOR CUSTOMERS SUPPLIED BY CITY-OWNED UTILITY WHEREAS, Section 23-13 of the Aspen Municipal Code provides that all electric rates shall be set forth in the most recent rate schedule to be set by City Council, and WHEREAS, the City Council is of the opinion that the rates imposed by the City of Aspen for its electric utility service should be adjusted immediately to reflect additional costs of supply and administration, and to conserve the energy resources; and WHEREAS, the City Council desires schedule which automatically passes to to establish a rate the public any future increase in costs of supply and administration. NOW, THEREFORE, BE CITY OF ASPEN, COLORADO: Section 1 The electrical rates for City IT ORDAINED BY THE CITY COUNCIL OF THE utility customers established in Section 1 of Ordinance No. 30, Series of 1976, and as amended by Ordinance No. 38, Series of 1978, such that on and after the July 31, 1980, billing there shall be imposed on all electricity customers of the City of Aspen for retail sales of electricity a usage charge for electricity actually used during a meter reading cycle (monthly) which usage charge shall be determined as the sum of the following factors times the consumer's kilowatt-hours used during the billing period: RECORD OF PROCEEDINGS 100 Leaves (a) Monthly Service Fee The amount of Five Dollars ($5.00) per month. (b) Base Charge - The amount of which shall be determined by dividing the annual base charge billed to the city by Public Serice Company by the total number of kilowatt hours billed to the City during the preceding twelve month period. (c) Demand Charge - The amount of which shall be determined by multiplying the current demand charge rate billed to the City by Public Service Company on a kilowatt basis times the ratio of the preceding twelve month period demand usage divided by the total kilowatt hours pur- chased. This formula historically reflects the averag- ing of peak demand to energy usage. (d) Fuel Adjustment Charge The amount of which shall be determined monthly to be equal to the City's cost of fuel adjustment as billed to it by Public Service Company. (e) Energy Charge - The amount of which shall be determined monthly to be equal to the City's energy charge per kilowatt hour as billed to it by Public Service Com- (f) pany. Operations Charge - The amount of which shall be com- puted annually by dividing the amount of the City's adopted budget for the Electric Fund's operations, including the cost of line loss, capital costs and return on capital investment to the total kilowatt hours estimated to be purchased from Public Service Company during the ensuing year. The commercial and residential operations rates shall be allocated on the basis of their relative weighted share of the kilowatt hour sales. 2 RECORD OF PROCEEDINGS 100 Leaves Section 2 If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction~ such portion shall be deemed a separate, distinct and independent provision and such holding shall not remaining portions thereof.
