AN ORDINANCE AMENDING SECTION 2-26 OF THE ASPEN MUI~ICIPAL
CODE TO PROVIDE FOR ONE ALTERNATE MEMBER TO THE ASPEN
PLANNING AND ZONING COMMISSION
WHEREAS~ upon the recommendation of the Planning and Zoning
Commission, the City Council desires to provide for the appoint-
ment of one alternate member to the Planning and Zoning Commission
to facilitate the proceedings of said Conunission.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ASPEN, COLORADO;
Section 1
That Section 2-36 of the Aspen Municipal Code is hereby
repealed and reenacted to read as follows:
Sec. 2-36. Composition; appointn]ent; term.
The city planning commission shall consist of seven (7) mem-
bers who shall be appointed by the city council to serve
overlapping terms of four (4) years each. Of the seven (7)
members initially appointed by the city council~ four (4)
members shall serve until the first regular meeting in July
of 1973. Thereafter each member shall be appointed to serve
for a term of four (4) years. The city council shall also
appoint one (1) alternate member to the city planning commis-
sion for a term of t%~o (2) years which alternate member shall
vote only in the absence of one or more regular members~ All
members shall serve at the pleasure of the city council and
may be removed by a majority vote of the whole city council.
There shall be no restraint upon the number of terms any mem-
ber of the commission may serve.
Section 2
If any section, subsection sentence, clause phrase or por-
tion of this ordinance is for any reason held invalid or unconsti-
tutional by any court of competent jurisdiction, such portion
shall be deemed a separate, distinct and independent provision and
such holding shall not affect the validity of the remaining por-
tions thereof.
