AN ORDINANCE APPROVING A LEASE BETWEEN THE CITY AND COUNTY
AS LEASSEES AND STEVE SCHUBERT (CRITTER CORRAL) AS LEASOR FOR
ANIMAL CONTROL SHELTER WHICH LEASE IS ATTACHED TO EXHIBIT "A".
WHEREAS, City and County operate a joint animal control
program and need a shelter facility; and
WHEREAS, Steve Schubert operates a animal shelter at the
Aspen Airport Business Center: and
WHEREAS, It is in the best interests of the City and County
to lease such premises.
NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ASPEN, COLORADO:
Section 1
That the Lease Agreement annexed hereto as Exhibit "A"
between the City of Aspen and Steve Schubert, be and hereby is
approved and adopted.
Section 2
That the Mayor and the City Manager be and hereby are each
authorized and directed to execute Exhibit "A" and all other
documents necessary to complete the transaction described in
Exhibit "A", after the form of all documents has been approved
by the City Attorney.
Section3
If any section, subsection, sentence, clause, phrase or
portion of this ordinance is for any reason held invalid or
unconstitutional by any court of competent jurisdiction, such
portion shall be deemed a separate, distinct and independent
provision and such holding shall not affect the validity of the
remaining portions thereof. Section 4
A public hearing on the ordinance shall be held on the
day of ~zT~_/~A~~ , 1983, at 5:00 P.M. in
the City Council Chambers, Aspen City Hall, Aspen, Colorado.
