HomeMy WebLinkAboutordinance.council.075-83RECORD OF PROCEEDINGS 100 Leaves (Series of 19--'~) AN ORDINANCE PROVIDING FOR A ONE HUNDRED PERCENT (100%) EXEMPTION FOR ELECTRIC SERVICE AND WATER SERVICE USAGE CHARGES AND EQUIVA- LENT SUBSIDIES FOR THE ASPEN ICE GARDEN FACILITY; SETTING FORTH THE PERMITTED USES FOR THE EXEMPTION AND SUBSIDY MONIES, SUCH USES BEING FOR CAPITAL IMPROVEMENTS TO THE ICE GARDEN AND PROGRAMS TO REDUCE FEES FOR PUBLIC USE OF THE ICE GARDEN; AND SETTING FORTH A PROCEDURE FOR AN ANNUAL FUND TRANSFER WHEREAS, the City of Aspen owns the Aspen Ice Garden, a pub- lic ice-skating facility; and WHEREAS, the City operates electric service and water utilities serving customers within the City of Aspen; and WHEREAS, the City Council of the City of Aspen desires to create an account to pay for much-needed capital improvements to the Ice Garden and to reduce fees for the public use of the Ice Garden; and service WHEREAS, the Council has determined that it is in the best interests of the City to create this account by exempting the Ice Garden from electric service and water service usage charges by the electric and water utilities and thereby subsidizing the Ice Garden; NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO: Section That the Aspen Ice Garden, a City-owned public ice-skating facility located at 233 West Hyman Avenue in Aspen, is and hence- forth shall be exempted from the payment of standard electric ser- vice and water service usage charges for its operations. Further, that the electric and water service charges so exempted shall be calculated, accrued and transferred into an account to be spent solely on capital improvements to the Ice Garden facility and on programs to reduce fees for public use of the Ice Garden. RECORD OF PROCEEDINGS 100 Leaves Section 2 That the Finance Department is authorized and directed to make annual transfers from the Electric and Water Funds in amounts equal to the actual electric service and water service usage of the Ice Garden to an account to be improvements to the Ice Garden and public use of the Ice Garden. used solely for capital programs to reduce fees for Section 3 If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portions thereof.
