AN ORDINANCE APPROVING THE TERMS OF AN AGREEMENT BETWEEN THE CITY
OF ASPEN AND PITKIN COUNTY (AS OWNERS) AND THE GENERAL ELECTRIC
COMPANY (AS CONTRACTOR) FOR PERFORMANCE OF WORK IN ACCORDANCE WITH
THE CONTRACT DOCUMENTS FOR THE RUEDI DAM HYDROPOWER PROJECT AND
AUTHORIZING AND DIRECTING THE MAYOR TO EXECUTE SAID AGREEMENT ON
BEHALF OF THE CITY OF ASPEN
WHEREAS, there has been submitted to the City Council an
Agreement between the City of Aspen and Pitkin County (as owners)
and the General Electric Company (as contractor) for the perfor-
mance of work in accordance with the contract documents for the
Ruedi Dam Hydropower Project,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ASPEN, COLORADO:
Section 1
That the City Council of the City of Aspen does approve the
Agreement between the City of Aspen and Pitkin County (as owners)
and the General Electric Company (as contractor), attached hereto
and incorporated by this reference; and does further authorize the
Mayor, on the effective date of this ordinance, to execute said
Agreement on behalf of the City of Aspen.
Section 2
If any section, subsection, sentence, clause, phrase or
portion of this ordinance is for any reason held invalid or
unconstitutional by any court of competent jurisdiction, such
portion shall be deemed a separate, distinct and independent
provision and such holding shall not affect the validity of the
remaining portions thereof.
Section 3
A public hearing on the ordinance
