AN ORDINANCE APPROVING THE TERMS OF AMENDMENT II TO THE AGREEMENT
BETWEEN THE CITY OF ASPEN AND COUNTY OF PITKIN (AS OWNERS) AND
SHEAFFER & ROLAND, INC. PERTAINING TO PHASES 4 AND 5 OF ENGINEER-
ING SERVICES RELATIVE TO THE CONSTRUCTION OF HYDROELECTRIC FACILI-
TIES AT RUEDI RESERVOIR AND AUTHORIZING AND DIRECTING THE MAYOR TO
EXECUTE SAID AGREEMENT ON BEHALF OF THE CITY OF ASPEN
WHEREAS, there has been submitted to the City Council an
Agreement between the City of Aspen and Pitkin County (as owners)
and Scheaffer & Roland, Inc. pertaining to Phases 4 and 5 of engi-
neering services relative to the construction of hydroelectric
facilities at Ruedi Reservoir,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ASPEN, COLORADO:
Section 1
That the City Council of the City of Aspen does approve the
Agreement between the City of Aspen and Pitkin County (as owners)
and Scheaffer & Roland, Inc., attached hereto and incorporated by
this reference; and does further

Section 2
If any section, subsection,
portion of this ordinance is for
unconstitutional by any court of
sentence, clause, phrase or

remaining portions thereof.
Section 3
A public hearing on the ordinance shall be held on the ~
