(Series of 1974) AN ORDINANCE AMENDING THE UNIFORM BUILDING CODE, 1973, BY THE ADDITION OF SUBSECTION 9 TO SECTION 301(b) THEREOF REQUIRING THE SUBMISSION, BY BUILDING PERMIT APPLICANTS, OF ELEVATIONS FOR NEW AND SUBSTANTIALLY IMPROVED STRUCTURES IN THE SPECIAL FLOOD HAZARD AREAS OF THE CITY. WHEREAS, the City of Aspen, in order to support federal flood plain subsidies, must retain records of elevations for proposed structures within special flood hazard areas, and WHEREAS, the City Council wishes to incor- porate the requirement of submission of such elevations into the Uniform Building Code as part of the building permit application procedure, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF ASPEN, COLORADO: Section 1 That the Municipal Code of the City of Aspen, Colorado, is hereby amended by the addition of a subsection to Section 7-141 which said subsection reads as follows: "(m) The Uniform Building Code, 1973 edition, is hereby amended by adding number nine to Section 301(b) which said subsection shall read as follows: 'Sec. 301(b) Application 9. When construction is proposed in the special flood hazard areas, be accompanied by elevations (in relation to mean sea level) of the lowest floor (including base- RECORD OF PROCEEDINGS 100 Leaves ment) of all new or substantially improved structures located in the special flood hazard areas. If the lowest floor is below grade on one or more sides, the elevation of the floor immediately above must also be submitted. '" Section 2 If any provision of this ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of the ordinance or applications and to this end the provisions or applications of this ordinance are declared to be severable. Section 3 A public hearing on the ordinance shall be held on 2~¥,.7 ~.'~ , 1974, in the City Council Chambers~ City Hall Building, Aspen, Colorado.
