(Series of 1974)
AN ORDINANCE MAKING A SUPPLEMENTAL APPROPRIATION
IN THE AMOUNT OF THIRTY-FOUR THOUSAND FIVE HUNDRED
($34,500.00) DOLLARS TO THE CAPITAL PROJECTS FUND
OF THE WATER PROGRAM; AND DECLARING THAT AN EMER-
GENCY EXISTS REQUIRING IMMEDIATE ENACTMENT.
WHEREAS, The City Manager has certified that
there are available for appropriation revenues in
excess of those estimated in the 1974 City of Aspen
Budget, and
WHEREAS, application has been made by the City
Engineering Department for additional funds in the
amount of $34,500.00 to provide for the construction
of the Ridge of Red Mountain Pump Station, and
WHEREAS, the contract for such construction
project must be awarded prior to Tuesday, June 18,
1974, at which time the bidder's offer will expire,
and this appropriation must be'effective prior to
that date,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COUNCIL OF THE CITY OF ASPEN, COLORADO:
Section 1
That a supplemental appropriation be made to
the Capital Projects Fund of the Water Program in
the amount of Thirty-Four Thousand Five Hundred
($34,500.00) Dollars to be drawn from the general
revenues of the city of Aspen.
Section 2
That, by reason of the fact
that the winning
constructor's bid will lapse on June 18, 1974,
unless the contract award is made prior thereto,

it is hereby declared that an emergency exists
and that this ordinance is necessary to the immediate
preservation of the public property, health, peace
and safety and that it shall be in full force and
effect upon final passage and be published within
ten (10) days after final passage, or as soon there-
after as possible.
Section 3
If any provision of this ordinance or the
application thereof to any person or circumstance
is held invalid, such invalidity shall not affect
other provisions or applications of the ordinance
which can be given effect without the invalid
provisions or applications and to this end the
provisions or applications of this ordinance are
declared to be severable.
INTRODUCED AND APPROVED ON FIRST READING as
provided by law by the City Council of the City of
Aspen, colorado, at its continued regular meeting
held at the City of Aspen on the 12th day of June,
1974.
