HomeMy WebLinkAboutordinance.council.023-74RECORD OF PROCEEDINGS 100 Leaves ORDINANCE NO. ~,~_ (Series of 1974) AN ORDINANCE AMENDING SECTION 7-22 OF THE ASPEN MUNICIPAL CODE WHICH AMENDMENT MODIFIES THE QUALIFI- CATIONS OF APPOINTEES TO THE BOARD OF EXAMINERS AND APPEALS SO THAT IN THE EVENT A QUALIFIED ARCHITECT, ENGINEER, GENERAL CONTRACTOR, MASTER OR JOURNEYMAN PLUMBER, OR MASTER OR jOURNEYMAN ELECTRICIAN IS NOT AVAILABLE FOR APPOINTMENT, ANY QUALIFIED PRIVATE PERSON MAY BE APPOINTED BY THE ASPEN CITY cOUNCIL IN LIEU THEREOF. WHEREAS, the Aspen City Council has encountered considerable difficulty in finding persons who satisfy the residency and professional criteria for appoint- ment to the Aspen Board of Examiners and Appeals, and WHEREAS, the Aspen City Council wishes to modify the provisions of Section 7-22 of the Municipal Code relating thereto so that in the event qualified persons are unavailable for appointment to fill vacancies on the Board, the City Council may appoint private persons, whose occupations and interestS are wholly independent of all phases of the building and construction industry, in lieu of the architect, engineer, contractor, plumber or electrician provided for in said Section 7-22; NOW, THEREFORE, BE IT ORDAINED BY THE CITY cOUNCIL FOR THE CITY OF ASPEN, COLORADO: Section 1 That Section 7-22 of the Municipal code of the City of Aspen, colorado, is hereby amended to read as follows: "Sec. 7-22. Composition; term; qualifications. The board of appeals and examiners shall consist of seven (7) regular members and three (3) ex officio members. The seven (7) regular members shall be as follows: (1) One licensed architect. (2) A registered professional engineer. (3) A general contractor, class A or B licensed under this code. (4) A master or journeyman plumber licensed under this code. (5) A licensed journeyman or master electrician licensed under this Code. (6) Two private citizens whose occupations and interestS are wholly independent of all phases of the building and construction industry. PROVIDED, HOWEVER, IN THE EVENT THE CITY COUNCIL SHALL DETERMINE, NOT LESS THAN ONE MONTH AFTER A VACANCY OCCURS ON THE BOARD OF EXAMINERS AND APPEALS, THAT THERE IS UNAVAILABLE FOR APPOINTMENT A QUALIFIED ARCHITECT, ENGINEER, GENERAL CONTRACTOR, PLUMBER OR ELECTRICIAN TO FILL A VACANCY, THE CITY COUNCIL MAY, IN LIEU THEREOF, APPOINT AN ADDITIONAL PRIVATE CITIZEN OR CITIZENS, AS HEREIN DEFINED, SO AS TO MAINTAIN THE REGULAR MEMBERSHIP OF THE BOARD AT SEVEN. The ex officio members of the Board of Appeals and Examiners shall be: (1) The Building Inspector who shall act as secretary of the board. (2) The chief of the fire department. (3) A member of the board of zoning adjustment." Section 2. If any provision of this ordinance or the application thereof to any person or circumstance shall be found to be invalid, such invalidity shall not affect any remain- RECORD OF PROCEEDINGS 100 Leaves ing portion or application thereof which can be given effect without the invalid portion or application, and to this end the provisions of this ordinance are declared to be severable.
