RUGHEIMER, CONTAINING 7.9 ACRES MORE OR LESS, ANNEXING THE SAME PURSUANT TO THE COLORADO MUNICIPAL ANNEXATION ACT OF 1965. ~HEREAS, there has been submitted a petition for annexation by David E. Barbee, John W. Barbee and Hallie B. Rugheimer, which petition has been presented pursuant to the colorado Municipal Annexation~,~t of 1965, C.R.S. 196~, Sections 139-21-1 throu~g~~''139-21-23, as amended, and ~ - / WHEREAS, sa'~~h~been x//O~~ the City Council of ~e cito~Pen ~aid City Council having found-~at. 1. Th~ the petit~-~esent the owners of one hundred per cent (100%) of the land included in the tract to be annexed; 2. Not less than one-sixth (1/6) of the perimeter of the area to be annexed is contiguous to the City of Aspen; 3. There exists a community of interest between the tract to be annexed and the City of Aspen; the tract to be annexed is urban or will be urbanized in the near future, and the tract to be annexed is integrated or is capable of being integrated with the City of Aspen; 4. The annexation will not affect the constitution of any existent school district; RECORD OF PROCEEDINGS 100 Leaves 5. The petition satisfies the statutory requirements of the Municipal Annexation Act both in substance and form, and WHEREAS, Section 139-21-6(1) (h) of the Municipal Annexation Act provides that where a petition for annexation is signed by the owners of 100% of the property proposed to be annexed, the City Council may, by ordinance, annex without notice and hearing, and without election, and the City Council wishes to so proceed, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO: Section 1. That the following described tract, situate in Pitkin County, Colorado, be and hereby is annexed to the City of Aspen, pursuant to the provisions of the colorado Municipal Annexation Act: A parcel of land being part of the NE ¼ of the NE ¼ of Section 13, Township 10 South, Range 85 West of the 6th Principal Meridian. Said parcel is more fully described as follows: Beginning at a point whence the northeast corner of said Section 13 bears East 1320.00 feet; thence East 373.73 feet; thence S 42°23' E, 477.44 feet to the West line of Garmisch Street; thence S 14°50'49" W, 77.41 feet along the West line of Garmisch Street to the northeast corner of Lot 2, Block 5, Eames Addition; thence N 75°09'11" W 346.50 feet; thence S 14°51' W, 1,015.21 feet; thence West 80.61 feet; thence North 171.67 feet; thence N 14°57' E, 650.59 feet; thence N 75°03' W, 173.72 feet; thence North 474.94 feet to the point of beginning. Said parcel containing 7.9196 acres, more or less. Section 2. That if any provision, section or clause of this ordinance or the application thereof to any person or -2- RECORD OF PROCEEDINGS 100 Leaves circumstance shall be found to be invalid by a court, such invalidity shall not affect any remaining portion or application which can be given effect without the invalid portion or application, and to this end this ordinance is declared to be severable. Section 3. That a public hearing be held at 5 P.M. on the day of , 1974, in the City Council Chambers, City Hall, Aspen, Colorado.
