ORDINANCE NO. ~t~
(Series of 1974)
AN ORDINANCE PROVIDING FOR A SURCHARGE UPON THE
ELECTRIC CONSUMERS OF THE CITY OF ASPEN WHICH
SURCHARGE SHALL TOTAL 10% OF EACH MONTHLY
BILLING FOR ELECTRICAL POWER SUPPLIED.
WHEREAS, the Aspen City Council has been apprised
by the Public Service Company of Colorado that increased
fossil fuel costs indicate the need for increases
in the cost of wholesale supply of electricity to the
City of Aspen, and
WHEREAS, the City of Aspen must provide for an
increase in its retail electric rates for the supply
of electricity to absorb these anticipated increases,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL
OF THE CITY OF ASPEN, COLORADO:
Section 1
That from the effective date of this ordinance,
or September 15, 1974, whichever occurs later, there
shall be imposed a surcharge on all electricity customers
of the City of Aspen for retail sales of electricity,
which surcharge shall be in an amount equal to ten
(10%) per cent of the total monthly charge for
electricity supplied to each such customer and shall
be in addition to any and all other charges on an
approved rate schedule effective at that time.
Section 2
If any provision of this ordinance or the application

thereof to any person or circ~stance is held invalid,
such invalidity shall not affect other provisions or
applications of the ordinance which can be given effect
without the invalid provisions or applications and
to this and the provisions or applications of this
ordinance are declared to be severable.
Section 3
A public hearing on this ordinance shall be held
on Y~.~ ~ , 1974, at 5 P.M.
in the Cit~Council Chambers, Aspen City Hall,
Aspen, Colorado.
