ORDINANCE NO. ~
(Series of 1974)
AN ORDINANCE PROVIDING FOR A SURCHARGE UPON THE
ELECTRIC CONSUMERS OF THE CITY OF ASPEN WHICH
SURCHARGE SHALL TOTAL 8½% OF EACH MONTHLY
BILLING FOR ELECTRICAL POWER SUPPLIED
WHEREAS, the Aspen City Council has been advised
that Public Service Company of Colorado, its wholesale
supplies of electricity, has requested Public
utilities Commission approval of a substantial rate
increase, which increase will be passed on to the
City of Aspen, as retailer, and
WHEREAS, the City of Aspen must provide for
an increase in its retail electric rates for the
supply of electricity to absorb these anticipated
additional wholesale costs,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COUNCIL OF THE CITY OF ASPEN, COLORADO:
Section 1
That from the effective date of this ordinance,
or September 15, 1974, whichever occurs later, there
shall be imposed a surcharge on all electricity customers
of the City of Aspen for retail sales of electricity,
which surcharge shall be in an amount equal to eight
and one-half (8½) per cent of the total monthly charge
for electricity supplied to each such customer and
shall be in addition to any and all other charges
on an approved rate schedule effective at that time.
Section 2
If any provision of this ordinance or the application

thereof to any person or circumstance is held invalid,
such invalidity shall not effect other provisions or
applications and to this end the provisions or
applications of this ordinance are declared to be severable.
Section 3
A public hearing on this ordinance shall be
held on ~.~,.~.~ ,~. , 1974, at 5 P.~.,I.
in the City Cou il Chambers, Aspen City Hall, Aspen,
Colorado.
