ORDINANCE NO. 51
(Series of 1974)
AN ORDINANCE ANNEXING A TRACT OF LAND COMMONLY
KNOWN AS THE 'THOMAS PROPERTY' ADJACENT TO THE
CITY OF ASPEN CONTAINING 29.21 ACRES MORE OR
LESS AND ANNEXING THE SAME PURSUANT TO THE
REQUIREMENTS OF THE COLORADO MUNICIPAL ANNEX-
ATION ACT OF 1965
WHEREAS, there has been submitted a Petition for
Annexation for a tract consisting of approximately 29.21
acres adjacent to the City of Aspen, which Petition has
been presented pursuant to the provisions of the Colorado
Municipal Annexation Act of 1965, and
WHEREAS, said Petition has been considered by
the City Council of the City of Aspen and said Council having
found that:
1. The signature on the Petition represents the
owner of One Hundred (100%) per cent of the land included
in the tract to be annexed;
2. Not less than one-sixth (1/6) of the perimeter
of the area to be annexed is contiguous to the City of Aspen;
3. There exists a community of interest between
the tract to be annexed and the City of Aspen; the tract to
be annexed is urban or will be urbanized in the near future;
and the tract to be annexed is integrated with the City;
4. The annexation will not affect the constitution
of any existent school district;
5. The Petition satisfies the statutory require-
ments of the Municipal Annexation Act both as to substance
and form; and
WHEREAS, Section 139-21-6(1) (h) of the Colorado
Municipal Annexation Act provides that were a Petition for
Annexation is signed by the owners of One Hundred Per Cent

of the property proposed to be annexed, the City Council
may, by ordinance, annex without notice, hearing or
election, and the City Council wishes to so proceed;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COUNCIL OF THE CITY OF ASPEN:
Section 1
That the following described tract, situate in
Pitkin County, Colorado, be and hereby is annexed to the
City of Aspen, Colorado, pursuant to the provisions of the
Colorado Municipal Annexation Act:
A tract of land being in Lots 8, 9, and 10 and the
SW ¼ SW ¼ Section 12 Township 10 South, Range 85 West
of the 6th Principal Meridian, being described as
follows:
Beginning at a point of intersection in the South
right-of-way line of State Highway 82 also being in
the East right-of-way line of the Castle Creek Road
bearing S 10032'20'' E, 332.91 feet from the West ¼
corner of Section 12, Township 10 South, Range 85 West,
6th Principal Meridian, (a 1954 brass cap in place);
thence S 16036' E, 135.87 feet along the easterly
right-of-way line of Castle Creek Road;
thence S 20054' E, 2006.31 feet along the easterly
right-of-way line of Castle Creek Road;
thence S 32010' E, 67.10 feet along the easterly
right-of-way line of Castle Creek Road;
thence N 18014' E, 373.92 feet; thence N 31021' W,
93.16 feet; thence along a curve to the right, radius
of 408.10 feet, a distance of 221.14 feet, (chord
bears N 15049'30'' W, 218.46 feet); thence along a
curve to the right, radius of 663.65 feet, a distance
of 100.00 feet (chord bears N 04001' E, 99.91 feet);
thence N 08020' E, 245.00 feet; thence along a curve
to the left, radius of 448.22 feet, a distance of 235.07
feet, (chord bears N 06°41' W, 232.39 feet);
thence along a curve to the right, radius of 2964.8
feet, a distance of 136.07 feet, (chord bears N 49011' W,
136.07 feet); thence N 47052' W, 458.00 feet;
thence S 88°24'E, 308.36 feet; thence S 47052' E,
215.00 feet; thence along a curve to the left, radius
2764.8 feet, a distance of 454.01 feet, (chord bears
S 52034' E, 453.50 feet); thence N 25028' E, 568.33
feet; thence N 21047' E, 282.37 feet; thence N 10051' E,
90.71 feet to the South right-of-way line of State
Highway 82; thence along a curve to the left, radius
of 905.00 feet, a distance of 416.88 feet (chord bears
S 87041' W, 413.21 feet) along the South right-of-way
line of State Highway 82' thence S 74027' W, 272.30 feet
along the South right-of-way line of State Highway 82;
thence along a curve to the right, radius of 1196.0 feet,
a distance of 919.54 feet (chord bears N 83031' W,
897.06 feet) along the South right-of-way line of State
Highway 82 to the point of beginning. Containing 29.21
acres more or less.

Section 2
That if any provision, section or clause of
this Ordinance or the application thereof to any person
or circumstance shall be found to be invalid, such
invalidity shall not affect any remaining part which can
be given effect without the invalid part or application,
and to this end this Ordinance is declared to be severable.
Section 3
That a public hearing be had hereon at 5:00 p.m.
in the City Council Chambers, City Hall, Aspen, Colorado,
on , 1974.
