THE CITY OF ASPEN CONCERNING BUSINESS LICENSING WHICH AMENDMENT
ELIMINATES THE REQUIREMENT THAT A BUSINESS OCCUPY PREMISES
WITHIN THE CITY BEFORE IT BECOMES SUBJECT TO THE LICENSING RE-
QUIREMENTS OF ARTICLE II OF CHAPTER 12.
WHEREAS, the Municipal Code, Section 12-29 imposes
business license requirements on only those businesses occupy-
ing premises within the City of Aspen, and
WHEREAS, it is the intention of the City Council to
require licensing of all business activity within the City with-
out regard to whether there exists a business establishment
within the City limits; and to subject all those persons
doing business or engaging in any business activity or occup-
ation, or performing any part of such business or occupation
in the city, to the licensing requirements of Article II of
Chapter 12 of the Municipal Code,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF ASPEN, COLORADO:
Section 1.
That Section 12-29 of the Municipal Code of the City
of Aspen, Colorado, is hereby amended to read as follows:
"Sec. 12-29 Definitions
For the purposes of this article the following
terms, phrases, ~.~ords and their derivations
shall have the meanings herein given:"

"(a) Business. The word "business" is meant to
include all kinds of vocations, occupations, pro-
fessions, enterprises, establishments, and all
other kinds of activities and matters, together
with all devices, machines, vehicles and
appurtenances used therein, any of which are
conducted for private profit, or benefit, either
directly or indirectly within the City of Aspen.
(b) Casual Sale. The term "casual sale" is an
individual, single or incidental transaction which
in itself does not constitute the carrying on of
business.
(c) License or Licensee. The word "license"
or "licensee" as used generally in this article
shall include respectively the word "permit" or
"permittee" or the holder for any use or period
~time Of~ny similar privilege, wherever relevant
to any provision of this article or other ordinance
of the City.
(d) License Officer. The term "license officer"
is the Director of Finance of the City.
(e) Person. The word "person" is meant to include
individual natural persons, partnerships, joint
ventures, societies, associations, clubs, trustees,
trusts or corporations, or any officers, agents,
employees, factors, or any kind of personal repre-
sentatives of any other person, under either personal
appointment or pursuant to law."

If any provision of this ordinance, or the application
~hereof to any person or circumstance is held invalid, such
iv?lidity shall not affect other provisions or applications
of the ordinance which can be given effect without the invalid
provisions or applications, and to this end the provisions
or applications of this ordinance are declared to be sever-

A public hearing on this ordinance shall be held on

City Council Chambers, Aspen City Hall, Aspen, Colorado.
