HomeMy WebLinkAboutordinance.council.069-74RECORD OF PROCEEDINGS 100 Leaves ORDINANCE NO. ~ (Series of 1974) AN ORDINANCE REPEALING AND RE-ENACTING SECTION 7-165 OF THE MUNICIPAL CODE CONCERNING ELECTRICAL INSPECTION FEES ~{ICH. AMENDMENT ADOPTS THE STATE SCHEDULE OF FEES AS REQUIRED BY COLORADO REVISED STATUTES SECTION 142-2-19, AS AMENDED. WHEREAS, the General Assembly did in its House Bill 1495, add Section 142-2-19(1) (e) to the Colorado Revised Statutes, 1963, as amended, and WHEREAS, said House Bill 1495 did declare that electrical inspections are of statewide concern and provided that the max- imum fees chargeable for electrical inspections by any city, town, county or city and county shall not exceed those enumerated in Chapter 142, Article 2 of the colorado Statutes, and WHEREAS, the City of Aspen in its pending ordinance 55, Series of 1974, adopting by reference the National Electric Code, 1974 Edition, establishes a schedule not in conformity with the state statutory schedule, and which may result in imposition of inspection fees exceeding those provided for by the state, and WHEREAS, to avoid conflict with the state statute, the Aspen City Council wishes to eliminate from the Municipal Code its inconsistent Section 7-165, and provide for the imposition of the same fee schedule maintained by the State of Colorado, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO: RECORD OF PROCEEDINGS 100 Leaves Section 1. That Section 7-165 of the Municipal Code of the City of Aspen, colorado, is hereby repealed and re-enacted to read as follows: "Sec.7-165 Same - Fees Where a permit is required by this article there shall be imposed an inspection fee as determined by the schedule adopted in C.R.S. 1963, as amended, Section 142-2-19, as it exists or may hereinafter be amended." Section 2. If any provision of this ordinance or the application thereof to any person or circumstance shall be found to be invalid, such invalidity shall not affect any remaining portion or application which can be given effect, and to this end this ordinance is declared to be severable.
