AN ORDINANCE AMENDING SUBSECTION (e) OF SECTION 9
OF CHAPTER 24 OF THE MUNICIPAL CODE OF THE CITY
OF ASPEN, COLORADO, TO ESTABLISH A NEW METHOD OF
MEASURING THE MAXIMUM PERMISSIBLE HEIGHT OF BUILDINGS.
WHEREAS, the Aspen Planning and Zoning Commission has
studied the present height measurement provisions of the City
Zoning Code and has recommended that a new method of measuring
the maximum permissible height of buildings be adopted; and
WHEREAS, the City Council has reviewed such recommendations,
and believes that the proposed amendment represents an improve-
ment over the existing means of measuring building heights.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF ASPEN, COLORADO:
Section 1.
Subsection (e) of Section 9 of Chapter 24 of the Municipal
Code of the City of Aspen, Colorado, is hereby amended to read
as follows:
"(e) Height provisions:
Schools, churches, hospitals,and public buildings
for administration in a residential district - where
these uses are permitted in a residential district,
they may exceed the established height limitation
by 50 per cent provided all other requirements
for the district are complied with, and provided
the total floor area of the structure above grade
does not exceed the total area of the lot on which
the building is located. Where this 1:1 ratio is
not possible, the maximum height limitation for
the district shall not be exceeded.

THE HEIGHT OF A BUILDING SHALL BE THE MAXIMUM
DISTANCE POSSIBLE MEASURED AT RIGHT ANGLES TO THE NATURAL
UNDISTURBED GROUND SLOPE TO TKE TOP OF A FLAT OR MANSARD
ROOF~ OR TO THE MEAN HEIGHT BETWEENTl~E EAVES AND RIDGE OF
A GABLE~ HIP~ GAMBREL OR SIMILAR PITCHED ROOF. THE RIDGE OF
A GABLE~ HIP~ GAMBREL~ OR SIMILAR PITCHED ROOF MAY NOT EX-
CEED OVER FIVE FEET ABOVE THE SPECIFIED MAXIMUM HEIGHT
LIMIT. ANTENNAS~ CHIMNEYS~ FLUES~ VENTS OR SIMILAR STRUC-
TURES SHALL NOT EXTEND OVER TEN FEET ABOVE THE SPECIFIED
MAXIMU~ HEIGHT LIMIT. WATER TOWERS MAY NOT EXTEND OVER
FIVE FEET ABOVE THE SPECIFIED MAXIMU~ HEIGHT LIMIT. CHURCH
SPIRES AND FLAGPOLES MAY EXTEND OVER THE SPECIFIED MAXIMUM
HEIGHT LIMIT."
Section 2.

Section 3.
If any provisions of this ordinance or the application thereof
to any person or circumstance is held invalid, such invalidity shall
not affect other provisions or applications of the ordinance which can
be given effect without the invalid provision or application, and to
