(Series of 1973)
AN ORDINANCE AMENDING THE ZONING DISTRICT MAP OF
THE CITY OF ASPEN, COLORADO, DATED APRIL 3, 1967,
AS AMENDED, DESIGNATING THE PROPERTY KNOWN AS
"UTE CEMETARY" AS AN H, HISTORIC OVERLAY DISTRICT
WHEREAS, the City of Aspen is the owner of the following-
described parcel of real property situated within the City of
Aspen, County of Pitkin, State of Colorado, which property is
also known as "Ute Cemetary", to wit:
A tract of land being a part of Tract B (41)
Aspen Townsite Addition Sec. 18, T.10 S,R.84 W,
6 PM (plat approved May 21, 1957) and the Helen C.
Bird entry (plat approved December 22, 1891)
described as follows: Beginning at Cor. 9 of
Tract B (41) (a 1954 brass cap); thence NO°21'E
917.52 feet along 8-9 Tract B (41) to the inter-
section with the South line of Calderwood Sub-
division as monumented; thence S61°27'E 83.79
feet along the South line of Calderwood Sub-
division to the centerline of the Roaring Fork
River; thence S15°35'W 149.64 feet along the
centerline of the Roaring Fork River; thence
S23°15'E 222.00 feet along the centerline of the
Roaring Fork River; thence Si°40'W 156.00 feet
along the centerline of the Roaring Fork River;
thence S36°35'E 135.00 feet along the centerline
of the Roaring Fork River to the intersection
with line 11-10 of Tract B (41); thence South
268.13 feet along line 11-10 Tract B (41) to
Corner 10 of Tract B (41) also being Corner 9
of 3905 AM Riverside Placer (a sandstone rock
in place); thence S38°10'W 158.12 feet; thence
N60°24'W 125.00 feet; thence N3°21"E 65.80 feet
to the point of beginning, containing 3.03 acres
more or less; and
WHEREAS, the City of Aspen has requested that all of said
above-described property be designated as an H, Historic Overlay
District in accordance with the provisions of Section 9.1 of
Chapter 24 of the Municipal Code of the City of Aspen, Colorado;
and

WHEREAS, following the holding of a joint public hearing
in connection with the proposed designation, the Aspen Planning
and Zoning Commission and the Aspen Historic Preservation
Committee have recommended, by Joint Resolution dated March 8,
1973, that all of the above-described property be designated
as an H, Historic Overlay District.
NOW,THE~FORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ASPEN, COLORADO:
Section 1.
The Zoning District Map of the City of Aspen, Colorado,
dated April 3, 1967, as amended, is hereby amended by tho
designation of all of the above-described property, which
property is also known as "Ute Cemetary", as an H, Historic
Overlay District pursuant to the provisions of Section 9.1
of Ch~ter 24 of the Municipal Code of the City of Aspen,
Colorado.
Section 2.
A public hearing on the Ordinance shall be held on
Co~unc-~l /~/ , 1973, at ~'/3___~ P.M. in the City
Chambers, City Hall, Aspen, Colorado.
INTRODUCED, READ AND ORDERED published as provided by
law by the City Council of the City of Aspen, Colorado, at
its regular meeting held at the City of Aspen, Colorado, on
