HomeMy WebLinkAboutordinance.council.023-73RECORD OF PROCEEDINGS 100 Leaves ORDIN CE Series of 1973 AN ORDINANCE AMENDING SEC 5-30 OF THE ASPEN MUNICIPAL CODE EXTENDING TO ALL AREAS OF THE CITY OF ASPEN THE DOG LEASH REQUIREMENTS; DEFINING WHEN A DOG SHALL BE DEEMED RUNNING AT LARGE; AND DESCRIBING PENALTIES THEREFORE. WHEREAS, Section S-30 of the Aspen Municipal Code provides that a dog may not be permitted to run at large within the Commercial, AR, and Park zoned districts of the City of Aspen, and WHEREAS, Section 5-30 provides that a dog shall be deemed to be running at large when off or away from the~premises of the owner, possessor or keeper, and not under the direct control by leash, cord or chain no longer than ten in length and of sufficient strength to completely the dog, or within a vehicle or other confinement, WHEREAS, Section 5-30 other areas of the city a dog is under the~ or keeper; and WHEREAS, the City Council has determined that the leash requirements of Section 5-30 should be extended to all areas within the City of Aspen; NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF APSEN, COLORADO: Section 1. That Section 5-30 of (10) feet restrain and further provides that within all dog need not be on a leash if said control of the owner, possessor the Municipal Code of the City of Aspen, Colorado, is hereby amended to reas as follows: "Section Running at Large Restricted; Leash Control (a) It shall be unlawful for any owner, possessor or RECORD OF PROCEEDINGS 100 Leaves who keeps any dog to permit the same to run within the limits of the City of Aspen. (b) A dog shall be deemed to be running at off or away from the premises of the owner, or keeper thereof and not under the direct at large large when possessor control of the owner, possessor or keeper or his agent or servant or a member of his immediate family either by leash, cord, or chain no longer than ten (10) feet in length and of sufficient strength ~o completely restrain the dog, or within a vehicle or other confinement. (c) Any person convicted of violating any provision of this section shall, upon conviction, be fined in an amount not to exceed three hundred and 00/100 ($300.00) dollars, or by imprisonment for not more than ninety (90) days or by both Section 2. If any provision of such fine and imprisonment. this ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not effect other provisions or applications of the ordinance which can be given effect without the invalid provisions or applications, and to this end the provisions or applications of this ordinance are declared to be severable. Section 3. A public hearing on this ordinance ~o~cil City Hall Building, Chambers, shall be held on p. m. in the City Aspen, Colorado.
