HomeMy WebLinkAboutordinance.council.031-73RECORD OF PROCEEDINGS 100 Leaves ORDINANCE NO. ,3/ (Series of 197L~ ) AN ORDINANCE PROHIBITING PARKING ON THE STREETS AND OTHER PUBLIC AREAS WITHIN THE CITY OF ASPEN WITHOUT A PERMIT; DESCRIBING THE PERMITS TO BE ISSUED AND FEES THEREFORE; EXCEPTING EMERGENCY VEHICLES; AND EARMARKING GENERATED REVENUE FOR STREET AND TRANSPORTATION FACILITIES. WHEREAS, the City Council has determined that for the immediate preservation of public property and the public peace and safety that it must take measures to generate revenues for street maintenance, repair, and related transportation purposes, to enhance central core circulation, to apply more stringent regulation of curb anyoff-street public parking / areas, to make more efficient.//use o~f curb parking to com- pensate for parking areas implementation of the mall, to reduce .the ~n~hce upon the automobile for / central ..a~ea tra.r~spo~tation and reduce energy use, to segregate necessary ~urb parking from that not appropria~k~, and to en~"~urage public parking ~pon the ci~ o.w/1~ former railroa property, and use of pUblic trans~ort~jkio~'ilities,~- / and WHEREAS, it is the feet~ng of~ the council that all the above objectJ~{~es~C"~/~&~'accDmpllshed by imposing a city wide parking-by-pe~i~-only ~e~lation and that such a regulation be impo~ i~ediately, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLO~O: Section 1. / ~ "'~ /' aid in That it is the in~ention,7Of ~i~{~,~rdinance to implementing the re~o~hdati~ns of the formally adopted Regional Transportation Plan, to generate revenue for the City of Aspen for its street and transportation needs, to more RECORD OF PROCEEDINGS 100 Leaves efficiently regulate and use curb and other public parking areas, to reduce the dependence on the automobile in the central area and reduce energy demands and to increase the public use of the city owned former railroad property and the city sponsored transportation facilities. Section 2. From the effective date of this ordinance, no person shall park any automobile, truck, van, cycle or other vehicle on any street or public parking area, alley or other public right of way, except in the area designated for parking on the city owned former railroad property, unless such vehicle shall have properly displayed a parking permit issued by the City of Aspen. Section 3. Ail permits shall issue to the following schedule of Residential Parking Permit Term of Permit Eight days One Month One Year from the City of Aspen according fees for each corresponding term: Fee $2.00 7.50 25.00 Commercial Core Parking Permit Term of Permit Fee One Day $2.00 Eight Days 5.00 One Month 20.00 One Year 200.00 Public Service and Commercial Vehicle Permits Term of Permit One Year Fee $25.0O (2) RECORD OF PROCEEDINGS 100 Leaves Section 4. The Residential Parking Permit shall constitute authori- zation to park in all areas of the city other than that desig- nated Commercial Core for the purposes of this ordinance; provided, however, that all permittees shall comply with all other parking and traffic regulations effective in such areas. Section 5. The Commercial Core Parking Permit shall constitute authorization to park in that area designated Commercial Core for the purposes of this ordinance by the City Manager as well as all other areas of the city; provided, however, that all permittees shall comply with all other parking and traffic regulations effective in such areas. Section 6. The Public Service and Commercial Vehicle Permits shall issue only to taxi, delivery, service, and other commercial vehicles and shall constitute authorization to park in any area within the City of Aspen; provided, however, that all permittees shall comply with all other parking and traffic regulations effective in such areas. Section 7. None of the requirements of this ordinance shall apply to fire fighting equipment, ambulance, police vehicles, and other forms of emergency vehicles. Section 8. All revenue generated by sale and purchase of permits for parking as hereinabove provided for shall be put into the Permit Parking Fee Fund and earmarked and used exclusively for street repair and maintenance, snow removal, city owned and operated transit systems, implementation of the recommenda- tions of the Regional Transportation Plan, acquisition and (3) RECORD OF PROCEEDINGS 100 Leaves maintenance of public off street parking facilities, and other street and transportation related expenses. Section 9. A public hearing on this ordinance shall be held on , 197 at 5 p. m. in the City Council Chambers, City Hall Building, Aspen, colorado.
