HomeMy WebLinkAboutordinance.council.001-53ORDINANCE N0. 1 (Series of AN ORDINANCE CONCERNING THE EXTENSION OF THE INSURANCE SYSTEM ESTABLISHED BY TITLE II OF TH]~ FEDERAL SOCIAL SECURITY ACT TO SERVICES PERFORI~D BY INDIVIDUALS AS EMPLOYEES OF THE CITY OF ASPEN. WHEREAS, it is the considered opinion of the City Council of the City of Aspen, Colorado, that tae extenslom of the Social SecUrity System to the employees and the non-elected officers of the City of Aspen, Colorado, will be of great benefit by providing that said employees and non-elected officers may participate in the provisions of the Old-Age and Survivors~ Insurance S~stem; that the extension of the Social Security System will also be of great benefit to the City of Aspen by enabling it to attract and retain in its employment aigh oalib~ of personnel and thereby increase the efficiency of its g merit; and WHEREAS the State of Colorado, by an enabling. Act provided for in Section 218 of Public Law ?34, 81st Congress, and known and referred to as Chapter 237, Session Laws of 19~t, designated the Department of Employment Security, State of Colorado, to act as the Department to implement the coverage of employees and officers under the said 01d-Age and Survivors~ Insurance System; BE IT ORDAINED BY THE CITY COUNCIL OF TEE CITY OF AS?Ei~, COLORADO; Section 1. Plan and Agreement The City of Aspen is hereby authorized to execute and deliver to the Department of Employment Security, State of Colorado, a plan, or plans, and agreement, required under Section 5 of said enabling Act and the Social Security Act, to extend coverage to employees and officers of the City of Aspen and to do or perform all other acts and things necessary to institute and carry out the said plan, or plans, for coverage of said employees and non-elected officers under the 01d-Age and Survivo~' Insurance System. Section 2. Contribution Fund The Clerk is hereby authorized to establish and main- tain a system of payroll deductions from covered employees, which shall be matched with payments by the City of Aspen to be made into the Contribution Fund of the Social Security Act through the Department of Employment Security, and to make charges of this tax contribution by the City of ~spen to the fund, or funds, from which the wage or salary payments are issued to its employees. Payments are to be made in accordance with the provisions of Section 1400 of the Fedez~l Insurance Contribution Act for all services which constitute employment within the meainng of that Act. Payments made to the Department of Employ- ment Security~ State of Colorado, shall be due and payable on or before the 18th day of the month immediately following the completed calendar quarter, and any delinquent payments shall bear interest at the rate of 1/2 of i percentum per month until paid. Section 3. Appropriation. Appropriation shall be, and is hereby, made from the proper fund, or funds, of the City of Aspen for the amount necessary to be paid into the contribution fund as provided in Section 3 (c) (1) of the enabling Act a~d in accordance with the Plan, or Plans, and Agreement. Section 4. A~reement with Department of Employment Security. Authority is hereby given to the Mayor and the Clerk of the City of Aspen to execute and enter into an agreement with ~the Department of employment Security, State of Colorado~ in accordance with Chapter 237, Session Laws of 1951, and with paragraph 218 of the Federal Social ~ecurity Act, and said agreement s~all provide that the participation of the City of Aspen shall be in effect beginning and as of January 1, 1953.
