(Series of 1954) AN ORDINANCE RELATING TO THE SEWER SYSTEM OF THE CITY OF ASPEN, COLORADO, AND FIXING AND ESTABLISHING CHARGES AND RATES FOR THE SERVICES RENDERED BY THE CITY OF ASPEN IN CONNECTION WITH THE USE OF SAID SEWER SYSTEM AND ESTABLISH- ING RULES AND REGULATIONS FOR THE COLLECTION OF CHARGES AND PROVIDING PENALITIES FOR THE VIOLATION THEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO: Section 1. SEWER RENTAL CHARGES. That effective ~Ianuary l, 1955, there is hereby levied a quarterly rate or charge for the use of the sanitary sewers and sewage system in the City of Aspen, Colorado, for property situate within the corporate limits, thereof, and connected there- with, whatsoever the manner, as follows, to-wit: Private Residence (One Family) Duplex (Two Family) Apartment Houses (More than two Families) Hotels and Motels (Up to Thirty Rooms) Hotels and Motels ( More than Thirty Rooms) Filling Stations, Garages, Cafes, Theaters and Drug Stores Taverns and Bars Laundries Schools and Municipal Buildings For all other merchantile and business establishments, and sewers users not included in any of the above classifications $ 1.50 $ 3.00 $ 1.50 plus$.75 for each apartment $ 9.00 $ 9.00 plus $.50 for each additional room. $ 6. 8.00 oo, 10.00 5.00 Section 2. SEWER CONNECTION CHARGES. That in addition to the quarterly charges above made there shall be a charge of $25.00 payable in advance for a connection on any city sewer line. Section 3. METHOD OF COLLECTION. All sewer rental shall be billed quarterly and shall be paid within 30 days of the receipt of said bill, and all delinquint sewer charges shall consiitute a lien upon any lots, land, building or premises served and in the event said charges shall not be paid when due, the City of Aspen, may at its election certify the charge or charges to the County Treasurer of Pitkin County to be by him placed upon the tax list on the current year to be collected in the manner as other taxes are collected, with 10% added thereto to defray the costs of collection and all laws of the State of Colorado for the assessment and collection of gen- eral taxes including the laws for the sale of property for taxes and redemp- tion of the same shall apply. Section 4. SEWER FUND. The revenues derived from the above source shall be deposited, kept, paid out, used, and applied only in the manner and form provided for by Section 41(2) Chapter 163, '35 C. S. A., and for this purpose a special fund to be known and designated as the "Sewer Fund" of said City is hereby created and all such revenues shall be paid over and credited to said fund provided that nothing contained shall be con- strued as in any way prohibiting the City Council of the City of Aspen from applying and crediting to said fund moneys derived from taxation or other sources. Section 5. UNCONSTITUTIONALITY CLAUSE. If any section or part of this Ordinance is held invalid or unconstitutional by Court of Law by competent jurisdiction the remainder of the Ordinance and the applica- tion of its provisions shall not be effected thereby.
