Amy Guthrie, Historic Preservation Officer ~ r' - Aspen Music Festival and School, temporary banners, Resolution #'lJ-, Series of 1998 FROM: RE: DATE: November 9, 1998 SUMMARY: The Aspen Music Festival and School wish to purchase and hang banners in town this summer to commemorate their 50th anniversary, using the mounting brackets provided to the City by the Aspen Skiing Company, when they did a similar installation for their 50th anniversary in the winter of 1997. The banners will hang on the existing lightposts, in approximately 40 locations along Main Street and in the downtown core area, and will be in place from June 14 through August 22, 1999. Staff recommends Council approve the request with conditions. STAFF REVIEW: Section 26.36.030.B.3 allows for the installation of temporary banners which advertise a special campaign, drive, activity or event of a civic, philanthropic, educational, or religious organization for noncommercial purposes. These signs may be within the city right-of-way, with the approval of the city manager, however the maximum time they may be in place is fourteen days. Because the Aspen Music Festival and School proposes to hang the banners for the entire music season, an exception by City Council is needed. City Council may grant this exception via Section 26.36.110, Signs on public right of :wl!)C, which states: "It shall be unlawful to erect or maintain any sign in, on, over or above any land or right-of-way or on any property, including lightposts, belonging to the City of Aspen without the permission of the City Council. However, this section shall not be deemed to apply to signs posted by any duly constituted public authorities in the performance of their public duties, or to specific circumstances otherwise provided for in this chapter." So for any banner installation beyond the fourteen day exemption by the City Manager, Council approval is needed. With the Aspen Skiing Company proposal in 1996, the concerns of the Community Development Department, Streets, Parks, and the Electric Department regarding how and where the brackets would be installed were resolved. The brackets are permanently affixed to approximately 40 lightposts and the banners are usually installed by the Electric Department. Organizations using the brackets are asked to order a few extra banners as replacements in case of theft or other damage. Because the Aspen Music Festival and School proposes to use the banners for the whole summer, other organizations will be precluded from using them for the 1999 summer season. It is recommended that the City have a policy that the banners will be used on a rotating basis, except when an organization has a significant anniversary, such as 10, 25, 30,40, or 50 years. In these cases, Council may allow one group to use all of the banner locations for a longer period. The Electric Department has an on-going concern that organizations using the brackets understand that they wilL be hung as quickly as possible but that the crews cannot be pulled off of their regular work to complete the job. The City may want to look at having the Parks Department participate when the Electric Department's schedule is full. Additionally, a fee for the installation and removal of the banners is to be included in the 1999 City fee schedule, for requests made in 1999. RECOMMENDATION: Staff recommends that Council approve the Aspen Music Festival and School banners with the following requirements, as outlined in the attached Resolution: 1. The Aspen Music Festival and School may install banners on the existing brackets along Main Street and the Commercial Core from June 14 through August 22, 1999. 2. The Aspen Music Festival and School shall order 10 extra banners to be installed if necessary due to theft or other damage. 3. The Aspen Music Festival and School shall be exempt from the proposed fee for the installation of the banners, as established in the 1999 City fee schedule, as this application was accepted prior to the proposed fee schedule. Additionally, staff recommends that Council establish the following policy: 1. The City Council shall have a policy that the banner spaces will be used on a rotating basis, except when an organization has a significant anniversary, such as 10, 25, 30, 40, or 50 years. In these cases, Council may allow one group to use all of the banner spaces for a longer period. Yes we need a policy. This was something I had asked Stan to do before he left but I never got it...if you could write it up it would be very helpful. I will put it on the next Council Consent agenda. I will ask John W to include a fee in the fee schedule he does in December so fees will apply next year...your policy can simply reference the annual City fee schedule. This will not apply to MAA this year. Thanks again!
