Mayor Richards called the meeting to order at 5:05 p.m. with
Councilmembers McCabe, Paulson and Markalunas present.
RESOLUTION #46, SERIES OF 2000 - Purchase Real Property -
Waterplace Housing Unit
Councilman Markalunas moved to approve Resolution #46, Series of 2000,
purchase of Gervaise Dupree's unit at Waterplace Housing; seconded by
Councilman Paulson. All in favor, motion carried.
Councilman Markalunas moved to go into executive session at 5:08 p.m. for
the purpose of discussing potential property acquisition; seconded by Mayor
Richards.
John Worcester, city attorney, told Council his reason for an executive
session is that the city is in the process of negotiating a purchase contract for
the construction of affordable housing. If these negotiations are not held in
executive session, Council will be telling the other side the city's negotiating
position.
Councilman Markalunas and Mayor Richards in favor; Councilmembers
Paulson and McCabe opposed. Motion NOT carried.
Mayor Richards said she does not feel it is fair to have a public meeting
without the Zoline representatives present. Councilman Markalunas agreed.
Councilman McCabe moved to reconsider the previous motion; seconded by
Mayor Richards. All in favor with the exception of Councilman Paulson,
motion carried.
Councilman Markalunas moved to go into executive session for the purpose
of discussing property acquisition; seconded by Councilman McCabe.
Mayor Richards said the ability to go into executive session is an important
obligation of the Council in order to negotiate the best deal for property
acquisition. Councilman Paulson said he does not favor fast tracking public
projects. Councilman Paulson said the Burlingame/Zoline should go
through the same process as everyone else. Councilman Paulson said he has
a problem with the Mayor meeting with staff, making decisions and
representing Council. Councilman Paulson said there should be a better

process rather than relying on one Councilperson. Mayor Richards noted
Council has been negotiating with the Zolines for over 9 months. There has
been a public design charette on this property. Councilman Paulson said he
would like at least two Councilmembers involved in meetings with staff on
issues like this. Councilman Paulson said he has asked for a wildlife report,
which he has not seen; a water report, which he has not seen; and a sewer
report, which he has not seen. Councilman Paulson said he needs to have
this information to make any decision on this project.
Roll call vote; Councilmembers Markalunas, yes; Paulson, no; McCabe, yes;
Mayor Richards, yes. Motion carried.
John Colson, Aspen Times, objected to this executive session as the
Burlingame/Zoline is an item of great public interest and should be
discussed in public.
Council went into executive session at 5:30 p.m.
Councilman Markalunas moved to come out of executive session at 7:30
p.m.; seconded by Councilman McCabe. All in favor, motion carried.
Councilman McCabe moved to adjourn at 7:30 p.m.; seconded by
Councilman Markalunas. All in favor, motion carried.
