Hiklich, p.~corde~ RECORD OF PROCEEDINGS ORDINANCE NO. ~ (Series of 1972) 100 Leaves AN ORDINANCE VACATING EASEMENTS FOR UTILITIES PREVIOUSLY RESERVED IN ORDINANCE NO. 1 (SERIES OF 1957). WHEREAS, the City of Aspen vacated by Ordinance No. 1, (Series of 1957), certain portions of Bleeker Street and Eighth Street and alleys within Blocks 6, 5 and 11 in the City of Aspen, and which Ordinance further reserv- ed easements for utilities in said vacated streets and alleys subject to certain conditions. AND WHEREAS, it has been determined that the reservation of utility easements in said streets and alleys is no longer in the public interest, and that the withdrawal of the reservation of utility easements subject to easements presently existing and in place, is in the best interest of the City. AND WHEREAS, the owner of the property contiguous and adjacent to the vacated streets and alleys has offered to convey to the City of Aspen a portion of real property adjacent to Highway 82 for the purpose of enlarging said highway for safer means of travel. NOW, THEREFORE, BE IT ORDAINED BY THE CITY cOUNCIL OF THE CITY OF ASPEN, COLORADO: Section 1. That the rights of the City under the reservation of utility easements within the following described real property, to wit: Ail that part of Eighth Street in the City of Aspen from its intersection with the southerly line of Hallam Street thence southerly to its intersection with the northerly line of Bleeker Street in the City and Townsite of Aspen; and RECORD OF PROCEEDINGS 100 Leaves Ail that part of Bleeker Street in the City of Aspen from its intersection with the westerly line of Eighth Street thence wester- ly to the westerly boundary of the City and Townsite of Aspen; and Ail alleys being within the exterior boundar- ies of Blocks 6, 5 and 11, City and Townsite of Aspen; shall be and the same hereby are vacated as public easements, subject to easements five (5) feet on either side of utilities existing and in place along and across the said vacated streets and alleys, which are hereby reserved to the City. Section 2. A public hearing on the Ordinance shall be held on ~, ~ /o/ /?~_~ , at ~-oP.M. in the City Council ~ambe~, City Hall, Aspen, Colorado.
