HomeMy WebLinkAboutordinance.council.034-17 ORDINANCE NO. 34 (SERIES OF 2017) AN ORDINANCE OF THE ASPEN CITY COUNCIL GRANTING APPROVAL OF A PLANNED DEVELOPMENTAMENDMENT FOR LOT 1, SOUTH ASPEN O STREET PUD/SUBDIVISION o O �w U Parcel ID: 273513139001 = 0 as c Cc, -. 0 WHEREAS, the Community Development Department received an application NO x from ASV Aspen Street Owners, LLC represented by BendonAdams requesting three Za amendments to the approvals granted via Ordinance No. 23 (Series of 2013); and, —MZm 'a 'JON– ' WHEREAS,the request is to modify three setbacks on the property associated with _CO o;N Building C by less than a foot each; and, 0uio >o p ri Y WHEREAS, upon initial review of the application and the applicable code w ° u standards, the Community Development Department recommended approval of the � OUe- C W O m am application; and, — ao � WHEREAS, the Aspen City Council has reviewed and considered the development proposal under the applicable provisions of the Municipal Code as identified herein, the Community Development Director's recommendation, and has taken and considered public comment at a public hearing; and, WHEREAS,the City Council finds that the development proposal meets or exceeds all applicable development standards; and, WHEREAS,the City Council finds that this Ordinance furthers and is necessary for the promotion of public health, safety, and welfare. NOW,THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO THAT: Section 1: Approvals Pursuant to the procedures and standards set forth in Title 26 of the Aspen Municipal Code, the City Council approves a Planned Development – Minor Amendment to a Project Review to modify the two setbacks as noted below. Aspen Street PUD/Subdivision 'Page I of Section 2• All material representations and commitments made by the Applicant pursuant to the development proposal approvals as herein awarded, whether in public hearing or documentation presented before the Historic Preservation Commission or City Council, are hereby incorporated in such plan development approvals and the same shall be complied with as if fully set forth herein, unless amended by an authorized entity. Section 3: This Ordinance shall not affect any existing litigation and shall not operate as an abatement of any action or proceeding now pending under or by virtue of the ordinances repealed or amended as herein provided, and the same shall be conducted and concluded under such prior ordinances. Section 4: If any section, subsection, sentence, clause, phrase, or portion of this Ordinance is for any reason held invalid or unconstitutional in a court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and shall not affect the validity of the remaining portions thereof.
