Specifically, the Applicants are requesting the ability to add a triangular piece ofland to the activity and buildingenvelopes on the north-western edge of the existing building envelope as can be seen in the draft plat attached as Exhibit "B". Additionally, the Applicants have requested to remove some area of land from the existing activity envelope on the north-eastern edge of the existing activity envelope and reconfigure the north-eastern edge of the building envelope as also is shown on the draft plat attached as Exhibit "B". APPLICANT: Patricia and Llwyd Ecclestone, represented by Keith Howie. LOCATION: Lot 4, Block G, Aspen Highlands Village Subdivision/PUD ZONING: R-15 PUD REVIEW PROCEDURE: The Community Development Director, pursuant to Land Use Code Section 26.445.100, Planned Unit Developments, may approve insubstantial amendments to an approved PUD. STAFF COMMENTS: In reviewing the request, Staff believes that the proposal is consistent with the City's internal building envelope adjustment policy guidelines. The Applicants have obtained approval from the Aspen Highlands Village Design Review Board (please see Exhibit "C") for the proposed change and are not increasing the overall size of the building envelope or activity envelope as is required by the City's policy for approving a building envelope adjustment administratively. The City of Aspen Parks Department has also reviewed the proposed amendment and has indicated that they do not believe that approving the request will allow for any greater disturbance of natural vegetation than if the existing building and activity envelopes were to remain in affect. 1 -.. '- RECOMMENDATION: Staff feels that the proposal meets the requirements for approving an insubstantial amendment to an approved PUD and recommends that the Community Development Director approve with conditions, this Insubstantial PUD Amendment to allow for the proposed building and activity envelope adjustments on Lot 4, Block G, Aspen Highlands Village SubdivisionlPUD. An insubstantial amendment to an approved development order for a final development plan may be authorized by the Community Development Director if the following review standards are met. 1. A change in the use or character of the development. Staff Findin!!: The use and intensity for Lot 4, Block G, of the Aspen Highlands Village SubdivisionlPUD remains the same as approved by the original PUD. Staff does not believe that the amendment changes the character of the development in a way which necessitates review by the Planning and Zoning Commission or City Council. Staff finds this criterion to be met. 2. An increase by greater than three (3) percent in the overall coverage of structures on the land. Staff Findin!!: The proposed building envelope adjustment will not increase the coverage of structures within the PUD. Additionally, the amended building envelope and activity envelope will contain the same amount' of square footage as the existing building and activity envelopes. Staff finds this criterion to be met. 3. Any amendment that substantially increases trip generation rates of the proposed development, or the demandfor publicfacUities. Staff Findin!!: Trip generation and demand for public infrastructure are not affected by this change. Staff finds this criterion not to be applicable to the proposed amendment. 4, A reduction by greater than three (3) percent of the approved open space. Staff Findin!!: The amount of open space within the PUD will not be reduced by the proposed building envelope adjustment. The amended building envelope and activity envelope will be the same size as the existing building and activity envelopes. The lot is heavily treed and in either scenario the impact will be great. So 1 am not concerned with the request for the change in the envelopes and activity envelope. However the developer and the owner must agree that the entire activity envelope will be fenced off at all times and that access to the construction area will only be reached from the road side of the lot not around the lot. There will be no variances or reasons to disturb the areas outside of the activity envelope. Thanks.
