RED ONION Mayor Pro Tem Behrendt called the special meeting to order at 4:55 p.m. with Councilmember~
EXPANSION Van Ness, Collins, Parry and Michael present.
Mayor Pro Tem Behrendt said this is a request to reconsider the Red Onion's request to
expand their mall premises across the entire building. Councilman Parry said the motion
for the entire premises was voted down; the second motion to allow original premises was
passed. Councilmembers Parry and Isaac said they wanted the entire expansion be allowed.
Councilman Parry moved to reconsider the Red Onion expansion; seconded by Councilman
Collins. All in favor, motion carried.
Councilman Parry moved to approve an area for the Red Onion in the mall 10 feet by 90 feet
with 45 degree corners~ conforming with the standards of the Mall Commission; seconded
by Councilman Van Ness. All in favor, with the exception of Councilwoman Michael. Council
man ISaac entered Chambers and voted aye. Motion carried.
CouncilWoman Michael moved to adjourn the Ispecial meeting at 5:10 p.m.; seconded by
Councilman Collins. All in favor, motion carried.
City Manager Chapman explained to Council the ACAC had submitted petitions to have
questions on the November ballot regarding taxes and revenue bonds. These petitions were
certified by the city clerk having 5 per cent signatures of registered voters. Today
it was discovered by the city attorney a Charter amendment petition requested 10 per
cent signatures. On the petition regarding revenue bonds, insufficient information was
given out and a section was missing. Chapman said there would not be time for the ACAC!~.
to get the petitions redone and be on the November ballot. Council does have the ability
to put these questions on the ballot by ordinance. Councilwoman Michael said she did not
feel Council should stand in the way of these questions. Council directed staff to work
out a reworded amendment with the ACAC that would be to their satisfaction as well as the
city's bond counsels'.
Councilmembers Van Ness and Isaac agreed to call a special meeting for Wednesday, August
20 at 4:30 p.m. to consider these Charter amendments.

Isaac, Michael and Van Ness present.
RESOLUTION #17 City Attorney Stock presented R~solution #17, which must be approved by Council in order
to reject the petitiOns. This document rejects both petitions, the petition amending
Section 12 based on the number of signatures and the petition amending Section 10.5
based on the number of signatures as well as the text problem. The staff is not asking
Council to make any decision on the alternative language for the questions. This will
come up at the next regular meeting. Mayor Pro Tem Behrendt outlined the suggestion that
Council reject the petitions and if they choose, to make a commitment that there will be
an item on the election ballot similar to what these petitions ask for. The city manager
will work with the ACAC to get the wording correct. Councilman Van Ness pointed out there
is no choice about adopting Resolution #17 because it states their petitions are insufficiE ~t
because of the numbers of signatures which are required by state law.
Councilman Van Ness moved to read Resolution #17, series of 1980; seconded by Councilman
Isaac. All in favor, motion carried. The resolution was read by title by the city clerk.
Councilman Van Ness moved to adopt Resolution 917, Series of 1980; seconded by Councilman

City Attorney'Stock told Council he had been directed by the city manager to draft two
amendments which meet the intent of the committee. One section will say no new taxes
may be imposed by the ~ity without a vote of the people; ad valorem taxes, assessments,
mill levy may not be increased over and above 1979. Under Section 10.5 the statement is
that no revenue bonds may be issued without a vote of the people, with a possible excePtior
for real estate transfer tax bonds.

Councilwoman Michael moved to direct the city attorney and manager to meet with the Ail
Citizens Action Committee to work out two amendments to be put into ordinance form which
meet the intent of the Committee and that the issue be discussed Monday, August 25;
seconded by Councilman Isaac. All in favor, with the exception of Councilman Van Ness.
Motion carried.
Councilman Isaac moved to adjourn the special meeting at 5:10 p.m.; seconded by Councilman
Van Ness. All in favor, motion carried.
