(970) 704·-0885 e. bcs@quixnetnet MEMORANDUM To: Aspen Planning & Zoning Commission FROM: Joyce Allgaier, Community Development Deputy Director RE: 1260 Red Butte Drive Special Review to Vary the ADU Design Standards- Public Hearing DATE: APPLICANT: Donna I readwell PARCEL ID: 2735-013-16-002 ADDRESS: 1260 Red Butte Drive ZONING: R-30 PUD (Medium-Density Residential) with a Planned Unit Development Overlay CURRENT LAND USE: 23,740 SF lot. with an existing single-family dwelling unit. PROPOSED LAND USE: The applicant proposes to build an Accessory Dwelling Unit above the garage. The applicant is seeking Special Review approval to place the proposed ADU Above: 1260 Red Butte above the attached garage. BACKGROUND: The applicant is seeking special review approval to vary the ADU design standards to for an ADU above the attached garage. The property is zoned R-30 PUD (Medium-Density Residential) with a Planned Unit Development overlay. Nothing iii the PUD impacts the dimensional requirements of the underlying zone district nor does the PUD impact this proposal. The applicant is maintaining portions of the existing building but not enough of the building is being maintained to be considered a remodel. As the expansion of the existing house is considered a demolition and re-build. the applicant is required to mitigate with an Accessory Dwelling Unit or provide a cash-in-lieu payment. The payment amount has been calculated to be $157,496.01. The protective covenants of the Gaylord Subdivision restrict the number of buildings to one per lot. If the applicant meets the requirements of the Land Use Code she will be in violation of the subdivisions protective covenants. Therefore. the applicant is seeking Special Review to place the ADU above an attached garage. The ADU has an interior entrance through the front entry of the house and up a set of stairs. As shown on the plans. the entry can be accessed from the exterior. the garage and from the main house. Land Use Code Section 26.520.080(D) gives the Planning and Zoning Commission authority to approve, approve with conditions, or deny an application for a variance from the ADIJ design standards through special review if the proposed variations meet the following criteria: l. The proposed ADU is designed in a nianner which promotes the purpose of the ADU program, promotes the purpose of the zone district in which it is proposed, and promotes the unit's general livability: and, 2. The proposed ADU is designed in a manner which is compatible with or enhances the character of the neighborhood considering all dimensions, density, designated view planes, operating characteristics, traffic, arailability of on-street parking, availability of transit services, and walking proximity to employment and recreational opportunities. tTAFF COMMENTS: Staff recognizes the applicant is in a difficult situation because of the protective covenants. nonetheless, the City does not enforce protective covenants and cannot support a proposal that runs contrary to the standards. If the Planning and Zoning Commission seeks to approve the special review, staff suggests a re-design so that ali exterior access to the unit is provided. Requiring a potential resident of the ADU to walk through the garage or portion of the primary residence is not consistent with Review Standard #1 of the ADU Special Review criteria. HOUSING AUTHORITY RECOMMENDATION: The Aspen/Pitkin County Housing Authority has reviewed the proposal and recommends that the Planning and Zoning Commission approve with conditions the proposed special review application to vary the ADU design standards. STAFF RECOMMENDATION: Staff recommends that the Planning and Zoning Commission deny the special review application to waive the ADU design standards #5 finding that the review standards have not been met. Staff Finding The ADU is proposed to be located close to a bus stop and the site has ample parking. ACCESSORY DWELLING UNITS: According to Section 26.520.050. Design Standards. a\\ ADU's shall conform to the following design standards unless approved under a Special Review: 1. An ADU must contain between 300 and 800 net livable square feet. 10% of which must be a closet or storage area. A Carriage House must contain between 800 and 1,200 net livable square feet, 10% of which must be closet or storage area. 2, An ADU or Carriage House must be able to function as a separate dwelling unit. This includes the following: a) An ADU or Carriage House must be separately accessible from the exterior. An interior entrance to the primary residence may be approved, pursuant to Special Reviewi b) An ADU or Carriage House must have separately accessible utilities. This does not preclude shared services. c) An ADU or Carriage House shall contain a kitchen containing, at a minimum, an oven, a stove with two burners, a sink, and a refrigerator with a minimum of 6 cubic feet of capacity and a freezer; and. d) An ADU or Carriage House shall contain a bathroom containing, at a minimum. a sink, a toilet. and a shower. 3. One parking space for the AD[j or Carriage House shall be provided on-site and shall remain available for the benefit of the ADU or Carriage House resident. The parking space shall not be stacked with a space for the primary residence. 4. The finished floor height(s) of the ADU or Carriage House shall be entirely above the natural or finished grade, whichever is higher, on all sides ofthe structure. 5. The ADU or Carriage House shall be detached from the primary residence. An ADU or Carriage House located above a detached garage or storage area shall qualify as a detached ADU or Carriage House. No other connections to the primary residence, or portions thereof. shall qualify the ADU or Carriage House as detached. 6. Ati ADU or Carriage House shall be located within the dimensional requirements of the zone district in which the property is located. 7. The roof design shall prevent stiow and ice from shedding upon an entrance to an ADU or Carriage House. If the entrance is accessed via stairs. sufficient means of preventing stiow and ice from accumulating on the stairs shall be provided. 8. ADUs and Carriage Houses shall be developed iii accordance with the requirements of this title which apply to residential development iii general. These include. but are not limited to, the Uniform Building Code requirements related to adequate natural light. ventilation, fire egress. lire suppression, and sound attenuation between living units. This standard may not be varied. 9. All ADUs and Carriage Houses shall be registered with the Housing Authority and the property shall be deed restricted in accordance with Section 26.520.070 Deed Restrictions. This standard may not be varied. Under Section 26.520.080.D. Special Review, an ADU or Carriage House may be approved. with conditions based on conformance with the following criteria: 1. RECOMMENDATION: Due to the requirement that only one building can be constructed on each lot. the unit being proposed is located above an attached garage and the addition of the unit is still within the allowed FAR for the lot of 5,024 square feet, Staff recommends approval of this request with the following conditions: 1. Conditions 1 through 9 stated above are met. 2. The kitchen contains at least a two-burner stove with oven, standard sink, and at least a 6- cubic foot refrigerator plus freezer. 3. The property is in the R-30 Zone District. Allowable FAR is 5,024 square feet. There is no ADU currently on the property. Proposal: The Owner wishes to vary the ADU Design Standards by constructing a ADU above her existing attached Garage. Although we recognize that the current Design Standards spedfy that ADUs built within the City of Aspen be detached, the Gaylord Subdivision Protective Covenants limit the number of buildings to one per lot, requiring an ADU be attached to the primary structure. This ADU would be approximately 530 square feet, consisting of a studio living/sleeping space, full kitchen, full bath and walk- in closet. The unit is accessed by dedicated interior stairs at the second entrance to the home, and parking for a single vehicle is provided on site. The ADU is a component of a larger renovation and addition to the existing home. The completed project is to include a total of three bedrooms plus the ADU. Proposed total FAR, not including the allowed Garage exemption, equals 4,766 square feet; approximately 258 square feet less than the allowable 5,024 square feet of FAR allowed for the lot, The ADU is intended for housing for a long-term live-in Caretaker. The Unit would not be used for short-term rental. Conformance with Planning and Zoning Commission Criteria: 1. The proposed ADU is designed in a manner which promotes the ADU program by providing an efficient, yet fully equipped, dwelling unit that would house one or two people comfortably and with privacy. It promotes the purpose of the zone district in which it is proposed by preserving the open spaces of the area while using existing building footprint. The design of the ADU not only promotes its own general livability, but also that of the primary dwelling unit. 2. The proposed ADU is designed to be compatible with, and subordinate to, the primary residence. The location over the Garage creates a secondary massing for the complete building, and the materials, roof pitches and dormers of the ADU match the primary residence.
