Community Development Department
This Development Order, hereinafter "Order", is hereby issued pursuant to Section
26.304.070, "Development Orders", and Section 26.308.010, "Vested Property Rights",
of the City of Aspen Municipal Code. This Order allows development of a site specific
development plan pursuant to the provisions of the land use approvals, described herein.
The effective date of this Order shall also be the initiation date of a three-year vested
property right. The vested property right shall expire on the day after the third
anniversary of the effective date of this Order, unless a building permit is approved
pursuant to Section 26.304.075, or unless an exemption, extension, reinstatement, or a
revocation is issued by City Council pursuant to Section 26.308.010. After Expiration of
vested property rights, this Order shall remain in full force and effect, excluding any
growth management allotments granted pursuant to Section 26.470, but shall be subject
to any amendments to the Land Use Code adopted since the effective date of this Order.
This Development Order is associated with the property noted below for the site specific
development plan as described below.

requesting a Stream Margin Review, to allow an addition and remodel, at
729 E. Bleeker St.

The Community Development Director may approve development within ] 00
feet from the Roaring Fork River and its tributary streams, pursuant to Land
Use Code Section 26.435.040 (B).
STAFF COMMENTS:
Review criteria and Staff Findings have been included as Exhibit "A."
RECOMMENDATION:
Staff has reviewed this proposal and recommends that the Community
Development Director approve the addition and remodel of the Schlosser
Residence.
ApPROVAL:
I hereby approve this addition and remodel for the Schlosser Residence at 729
Bleeker St., finding that the criteria have been met.

Review Criteria & Staff Findings
The Community Development Director may exempt the following types of
development within the Stream Margin Review Area, pursuant to 26.435.040(8):
B. Exemptions.
1. Construction of pedestrian or automobile bridges, public trails, or structures/or
irrigation, drainage, flood control or water diversion, bank stabilization, provided plans
and :,pecifications are submitted to the City Engineer demonstrating that the structure is
engineered to prevent blockage of drainage channels during peakjlows and the
Community Development Director determines the proposed structure complies, to the
extent practical, with the Stream Margin Review Standard5.
Staff Finding: Staff finds that the proposed development does not include any of these
structures.
2. Construction of improvements essential for public health and safety which cannot be
reasonably accommodated outside of the "no development area" prescribed by this
Section including, but not limited to, potable water :,ystems, sanitary sewer, utilities, and
fire suppression :,ystems provided the Community Development Director determines the
development complies, to the extent practical, with the Stream Margin Review Standards.
Staff Finding: Staff finds that the proposed development does not include any of these
structures.
3. The expansion, remodeling, or reconstruction of an existing development provided the
following standards are met:
a. The development does not add more than ten (l0) percent to the jloor area of the
existing structure or increase the amount of building area exemptfromjloor area
calculations hy more than twentyJive (25) percent. All stream margin exemptions are
cumulative. Once a development reaches these totals, a Stream Margin Review by the
Planning and Zoning Commission is required; and,
h. The development does not require the removal of any tree for which a permit would
be required pursuant to Chapter 13.20 of this Code.
c. The development is located such that no portion of the expansion, remodeling or
reconstruction will be any closer to the high water line than is the existing
development;
d. The development does not fall outside of an approved building envelope if one has
been designated through a prior review; and
e. The expansion, remodeling or reconstruction will cause no increase to the amount of
ground coverage of structures within the 1 OO-year jlood plan.
Staff Finding: Staff finds that:
,
a) the development does not add more than ten (10) percent to the floor area of the
existing structure (the proposal adds 7.5% to the floor area of the existing structure), and
the development does not add more than twenty-five (25) percent of building area exempt
from floor area calculations (the proposal reduces deck space by 33%);
b) the development does not require removal of a tree for which a permit would be
required;
c) no portion of the development will be any closer to the high water line than is the
existing development;
d) the development does not fall outside the approved building envelope;
e) the development will not increase the amount of ground coverage of structures within
the I OO-year flood plan.

Dear Mr. Bendon,
Please find, herein and attached, our request for Stream Margin Exemption for
the above referenced property. Mr. & Mrs. Bradley F. Schlosser wish to add onto
and remodel their side of the existing duplex townhouse. The existing structure
was built in 1978-1979 prior to Stream Margin Ordinances.
In accordance with 26.435.040 B,3 the development;
a. Does not add more than ten (10) percent to the floor area of the
existing structure and does not increase the amount of building area
exempt from floor area calculations by more than twenty-five (25)
percent. (Existing 2,245 s.f.; New 2,415 s.f. See attached Building I
Zoning Data.);
b. The development does not require the removal of any trees for which a
permit would be required pursuant to Chapter 13.20 of the land Use
Code. (See attached Survey.);
c. The development is located such that no portion of the expansion or
remodel will be closer to the high water line than is the existing
development (See attached Survey and design drawings.);
d. The development does not fall outside of the approved building
envelope (See attached Survey.);
e. The expansion, remodel will not increase the amount of ground
coverage of the structure within the 100 year flood plane.
The existing exterior lighting will not be increased and if it is necessary to replace
any exterior lighting fixture, a fixture that reduces horizontal light emissions will
be chosen.

6. An Elevation Certificate stamped and signed by a Colorado registered
Land Surveyor;
7. Building and Zoning Data sheet showing zoning and area calculations;
8. Architectural plans showing existing and proposed area plans and
exterior elevations;
The proposed construction techniques shall be identical or similar to the existing
frame construction. All new addition construction and interior remodel
construction shall confonn to the requirements of the Building Code presently
adopted by the City of Aspen.
Accurate grade elevations are shown on the Site Survey and the Elevation
Certificate attached.

1. Attachment 1- Agreement for Payment of Development Application
Fees;
2. Attachment 2 - Land Use Application;
3. Attachment 3 - Dimensional Requirements Form;
4. A copy of the Pre-AppliCation Conference summary;
5. A check in the amount of $850.00 as a deposit for development review;

WHERBAS,
David Beckwith ("Applicant"), as represented by
Sunny Vann, submitted an application to the Planning Office to
amend the creektree SUbdivision/POD to revise the boundaries of
Lots 2 and 4, to increase the allowable floor area for the
Creektree Condominiums, and to clarify the City's existing access
easement across Lot 4;
WHBREAS, the Applicant is requesting a SUbdivision/PUD
amendment to utilize the lot area of Newbury Park to recalculate
the lot area for each lot and to create a separate parcel for each
duplex as provided by section 24-3-101 of the Aspen Municipal Code;
and
WHEREAS, the Applicant has obtained written permission from
all property owners within the SUbdivision/PUD to pursue this
SUbdivision/POD amendment; and
WHEREAS, the project was considered by the Planning and Zoning
Commission on October 18, 1994 at which time the Commission
conceptually recommended approval of the request by a 5-2 vote, and
granted Stream Margin Review by ReSOlution 94-37; and
WHEREAS,
the project was considered at a public hearing
before city Council on March 27, 1995 at which time Council
approved the applicant's request.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ASPEN, COLORADO, THAT;

Section 1: Pursuant to sections 24-7-903 and 24-7-1006(B) of the
Municipal Code, City council does hereby grant the applicant an
amendment to the SUbdivision/PUD that redefines the lot line
between Lot 2 and Lot 4, so that each of these lots contains one
duplex unit, of the Creektree Subdivision and utilizes the pun
provision of the Code to utilize the land area of Newbury Park to
recalculate the lot area on all lots, subject to the following
conditions:
1. The applicant shall redefine the building envelope, so that
it is closer to the existing Creektree Condominium structures
to prevent any disturbance closer to the Roaring Fork River,
with the amended PUD plat.
2.
The new PUD/Subdivision Plat must be approved by the Planning
Office and Engineering Department and recorded with the Pitkin
County Clerk and Recorder within 180 days of approval by City
Council. Failure to do so may render the approvals invalid.
3.
No vegetation shall be removed between the building envelopes
and the river.
4. Prior to removal of any trees, the applicant shall obtain a
tree removal permit from the Parks Department. The applicant
is required to either guarantee that the trees survive for up
to two years after relocation or, should they die, that they
are replaced with comparable trees.. Excavating around.
existing trees will need to be done outside of the dripline
of all trees.
5. All material representations made by the applicant in the
application and during public meetings with the Planning and
Zoning Commission shall be adhered to and considered
condi tions of approval, unless otherwise amended by other
conditions.
6. Prior to the issuance of any building permits for any lot
within the Creektree SUbdivision, a redefined fisherman I s
easement shall be executed for Lots 1,2, and 4.
7.
The Final Subdivision/PUD Plat shall indicate the location of
a locking gate for City of Aspen access to Newbury Park across
Lots 2 and 4.

Lot areas for the purpose of calculating FAR shall be 41,916
square feet for each lot within the Creektree SUbdivision/PUD.
The maximum allowable floor area for each duplex structure on
Lot 2 and Lot 4 shall be 5,876 square fee~. The calculation
of actual building floor areas shall be subject to the Aspen
Land Use Regulations and any amendment thereto.
section 2:
Pursuant to section 24-7-903 of the Municipal Code,
City Council does hereby grant the applicant a Planned Unit
Development sideyard setback variation for Lots 2 and 4. The north
sideyard setback for Lot 2 shall be varied from a minimum of 15
feet to 8.5 feet, the south sideyard setback shall be varied from
a minimum of. 15 feet to 7 feet, and the total setback shall be
varied from the required 50 feet to 16.5 feet. The north sideyard
setback for Lot 4 shall be varied from a minimum of 15 feet to 7
feet, the south sideyard setback shall be varied from a minimum of
15 feet to 4 feet, and the total setback shall be varied from the
required 50 feet to 11 feet.
Section 3: Pursuant to Section 24-6-207 of the Municipal Code, the
City council does hereby grant the applicant vested rights for the
Creektree Subdivision/PUD Amendment as follows:

The rights granted by the site specific development plan
approved by this Ordinance shall remain vested for three (3)
years from the date of final adoption specified below.
However, any failure to abide by the terms and conditions
attendant to this approval shall result in forfeiture of said
vested property rights. Failure to timely and properly record
all plats and agreements as specified herein and or in the
Municipal Code shall also result in the forfeiture of said
vested rights.

The approval granted hereby shall be subject to all rights of
referendum and judicial review.

3.
Nothing in the approvals provided in this Ordinance shall
exempt the site specific development plan from subsequent
reviews and or approvals required by this Ordinance or the
general rules, regulations or ordinances or the city provided
that such reviews or approvals are not inconsistent with the
approvals granted and vested herein.
4. The establishment herein of a vested property right shall not
preclude the application of ordinances or regulations which
are general in nature and are applicable to all property
subject to land use regulation by the city of Aspen including,
but not limited to, building, fire, plumbing, electrical and
mechanical codes. In this regard, as a condition of this site
development approval, the developer shall abide by any and
all such building, fire, plumbing, electrical and mechanical
codes, unless an exemption therefrom is granted in writing.
section 4:
This Ordinance shall not affect any existing litigation and shall
not operate as an abatement of any action or proceeding now pending
under or by virtue of the ordinances repealed o~ amended as herein
provided, and the same shall be conducted and concluded under such
prior ordinances.
section 5:
If any section, subsection, sentence, clause, phrase, or portion
of this Ordinance is for any reason held invalid or
unconstitutional in a court of competent jurisdiction, such portion
shall be deemed a separate, distinct and independent provision and
shall not affect the validity of the remaining portions thereof.
Section 6:
The City Clerk shall cause notice of this ordinance to be published
in a newspaper of general circulation within the City of Aspen no
later than fourteen (14) days following final adoption hereof.
Such notice shall be given in the following form:
Notice is hereby given to the general public of the approval
of a site specific development plan, and the creation of a
vested property right pursuant to Titie 24, Article 68,
Colorado Revised Statutes, pertaining to the following-
described property:
The property shall be described in the notice and appended to said
notice shall be the ordinance granting such approval.
section 7:
That the City Clerk is directed, upon the adoption of this

ordinance, to record a copy of this ordinance in the office of the
Pitkin county Clerk and Recorder.
Section 8: The City Clerk shall cause notice of this Ordinance to
be published in a newspaper of general circulation within the City
of Aspen, no later than fourteen (14) days following final adoption
hereof. Such notice shall be given. in the fOllowing form:
