HomeMy WebLinkAboutminutes.council.19600711 SPECIAL MEETING ASPEN CITY COUNCIL JULY 11~ 1960 The special meeting convened at 5:00 PM with Mayor Garrish, Councilmen Anderson, Beyer and Braun, and City Attorney Stewart present, also Attorney Chisholm representing Pascal Construction Co. Discussed - letter from Otto Haerdle regarding Luther House, requesting vacation of street. Attorney Stewart suggested that Mr. Haerdle be informed that the City does not elect to vacate. Mr. Stewart th~u went over the matter of the rejection of the water system installation bid 34 SPECIAL MEETING ASPEN CITY COb~CIL JULY 11, 1960 continued by Pascal Construction Company. The following Waiver of Notice was read and signed. WAIVER OF NOTICE AND CONSENT TO CITY COUNCIL MEETING We, the undersigned members of the City Council for the City of Aspen, do hereby waive notice of a special meeting of the Council to be held at Aspen, Colorado, July 11, 1960, at 5:00 p.m., in the Council Chambers, and do hereby consent that said meeting may be had for the purpose of considering settlement with the Pascal Construction Company with regard to its failure to proceed with the work in construction of a water distribution system according to the bid entered by said Pascal Construction Company. Dated this llth day of July, 1960, at Aspen, Colorado° Councilman Beyer moved that the City of Aspen accept the sum of $2,527.77 as liquidated damages to Pascal be paid to the City by Pascal Construction Company for its failure to enter into a contract according to amount of the bid heretofore entered by said company, and that the Mayor and the City Clerk shall be and are here- bid bond by authorized onbehalf of the City to execute an Agreement of Release heretofore tendered to the City by to City said Pascal Construction Company, a copy of which ~elease has been delivered to the City~lerk for filing with the permanent records of th~ City. Said motion was seconded by Couucilman Anderson. The following Councilmen voted 'yea': Wolf J. Beyer Alfred Braun F. W. Anderson The following Councilmen voted "nay": none. Discussed - Matter of water rights and flume maintenance. It was decided to ask Jim Moore, Whip Jones. )anny Berry and Attorne~ Delaney to meet with Council Monday, July 18, qt 6:00 PM. · Discussed - Attorney to handle Aspen Skating Rink suit. It was suggested that Judge Shaw be contacted. Rodeo lights - it was decided there were not enough fcr Wagner Park. Discussed - Variances in construction of new school - the representatives will be asked to meet with Council Monday, July 18, at 7:OOPM. Discussed - waterflow problem on Rob Roy property and main road to Ashcroft. The meeting was then adjourned.
