obtain at least three (3) certifications from ICC (Intemational Code Conference),

SlJMMARY:
Stan Clauson of Stan Clauson Associates, LLC, representative of the Maroon
Creek Club is requesting an insubstantial amendment to a Planned Unit
Development (PUD) approval for the addition of bathrooms and a storm refuge
near the 15'h tee on the Maroon Creek Club golf course. The size of the structure
will be 175 sq. feet and does not contribute to net leasable space.
Staff has reviewed this proposed amendment and recommends administrative
approval by the Director, with conditions.

I hereby approve this Insubstantial Amendment to the Maroon Creek Club Planned
Unit Development to construct a 175 sq. ft. bathroom and storm refuge structure
along the cart path on Golf Parcel D (west of the #13 Green and east of the #15 and
#16 Greens) with the following conditions:
I. Tree Removal: Any tree being removed or determined necessary to remove during
construction will require an approved tree permit prior to removal. An approved
tree permit requires a proposed landscape plan identifYing trees for removal and
means and schedule for mitigation. Please contact the City Forester for more
information 920-5120.
2. Tree Protection: A vegetation protection fence shall be erected at the drip line of
each individual tree or groupings of trees remaining on site.
a. A formal plan indicating the location of the tree protection will be
required in the bldg permit set.
b. There will be no storage of construction materials, backfill, tools or
construction traffic inside of the protective fence.
c. There is no excavation or disturbance of the native area inside of the
protective fence.
d. This fence must be inspected by the city forester or his/her designee
(920-5120) before any construction activities are to commence.
3. The applicant shall apply for and receive all necessary building permits prior to
the construction of the bathroom/storm refuge structure.

I . A change in the use or character of the development.
Staff Finding:
With this proposed amendment, the use and intensity remains the same as approved.
The change does not alter the character of the development.
2. An increase by greater than three (3) percent in the overall coverage of structures on
the land.
Staff Finding:
The increase of overall coverage of structures does not meet or exceed three (3)
percent.
3. Any amendment that substantially increases trip generation rates of the proposed
development, or the demand for public facilities.
Staff Finding:
Trip generation and demand for public infrastructure are not affected by this change.

Dear James:
On behalf of the owners of the Maroon Creek Club, Maroon Creek, LLC, we are writing to
request staff review of this application for the construction of a 175 s.f. shelter and
handicapped accessible restroom facility to be located in Golf Parcel D near the thirteenth
green of the Maroon Creek Golf Course. This area is currently served during the summer
by rented portable toilet facilities and their is no lightning protection available.
The additional 175 s.f. of development will meet all requirements for an insubstantial
amendment to the existing PUD and will not contribute to net leasable for purposes of
Growth Management. .
The location of this structure is in a grove of aspen trees and is not visible from Tiehack
Road. There is sewer service located on the hill above the site. An ejector plUllp will be
used to connect to the existing sewer. BOCC resolution 93- I 04 granted finaI approval for
the Maroon Creek Club. The language of the recitals clearly contemplated this type of
structure. Moreover, Paragraph 8.20 of the Master Declaration of Protective Covenants for
the Maroon Creek Club allows these structures in Golf Parcels A, B, C, and D.
This improvement will provide benefits to users of the club, while at the same time
offering aesthetic and safety enhancements. Please let me know if you require any
additional information as part of this application.

Located at the base of Buttermilk, the Maroon Club Golf Course was
designed by Tom Fazio and has subsequently become a world-renowned,
serving as a golf facility during the summer season and a Nordic ski area
in the winter. Since Maroon Club Golf Course is a frequented destination
year-round, it is imperative that adequate bathroom facilities are provided
for the members and guests. The Club currently rents portable toilets and
does not offer a lightning protection shelter at this location. The Maroon
Creek Club would like to construct a 175 square foot restroom structure,
with two handicapped-accessible restrooms and an overhang for lightning
protection.

The proposed site for the new restroom and shelter facility will be located
along the cart path on Golf Parcel D - west of the # 13 Green and east of
the #15 and #16 Greens. Even though the facility is located close to
Tiehack Road, it will be built in a grove of aspen trees, and screened from
the road. This location will provide easy access to the users along the
cart path. Moreover, the necessary infrastructure to service the restroom
facility already exists. Sewer service is located on the hill above the site,
and an ejector pump will be utilized. (These installations were approved
in BOCC Resolution 93-104, 4(d).) Once the new facility is built, the
rented portable toilet facilities by the #12 and #13 Greens will be
removed.
A previous approval transferred the remaining floor area allocated to
ancillary structures on the golf course to the expansion of the clubhouse.
Thus, a part of this request is to allow the additional floor area of 175 s.
f. to the Maroon Creek Club development. lt is our understanding that
these restrooms would not add to the Net Leasable area of the facilities
and would, therefore, not require any Growth Management approvals or
exemptions.

The proposed facility would add minimally to the allocated floor area of
the property, and at the same time, a necessary facility for the users of the
golf course. Moreover, the proposed structure will not only house two (2)
handicap accessible bathrooms, but also serve as a combination storm
shelter and lightning protection station for users of the course. This new
structure will provide a much needed facility as well as a safety
improvement during inclement weather.

26.445.100 Amendment of PUD development order.
A. PUD Insubstantial Amendments.
An insubstantial amendment to an approved development order for a final development
plan may be authorized by the Community Development Director. The following shall
not be considered an insubstantial amendment:

Response: The addition of the bathroom facility on the course will not change the use or
character of the golf and Nordic ski area. In fact, the proposed combination of
bathroom, comfort station, and lightning shelter would enhance the attractiveness of the
recreational area to all users.

the land.
Response: Thefacility ilselfis a minimal addition of /75 s.f to the allowable floor area,
and is not an increase greater than three (3) percent in the overall coverage of structures

Response: Since the restroom will only serve the users of the course, the proposed
structure will not generate additional traffic. Moreover, necessary public facilities
already serve the area, and demand for public facilities will not increase in any
significant way with the utilization of the /75 s. I restroom facility. Approved in BOCC
Resolution 93-104, 4(d), sewer service is located on the hill above the site, and an ejector
pump will be utilized

During the review of the proposed amendment, the Planning and Zoning Commission
and City Council may require such conditions of approval as are necessary to insure that
the development will be compatible with current community circumstances. lIDs shall

Response: This request to add a 175 s. f restroom structure is a necessary improvement
to the Maroon Creek Club golf course. The structure will increase the health, safety, and
welfare of the users of the facility.
The proposed restrooms benefit both members and guests in providing a necessary
facility, and the request would incur only minimal changes to the recreational area itself.
Public facilities already exist to serve the new bathroom, and the structure itself will be
constructed with an overhang to protect golfers from lightning. This architectural
element enhances the safety and welfare of the users since lightning is a threat on golf
courses. Moreover, it would replace the rented portable toilet facilities, thereby
improving the aesthetic appearance of the golf course in this location.
