Residential Design Standard Variance for 257 Park Avenue
SUMMARY: The subject property is a 9,000 square foot lot in the Moderate-Density
Residential (R-6) zone district. Currently, there are two single-family dwelling units and
construction is just being completed on both houses. The applicant is proposing a six (6)
foot fence between the house on the comer of Park and Dale A venues and the patio
building that is situated further east on Dale Avenue.
The applicant requests a variance from the Residential Design Standards related to the
requirement that, "a fence forward of the front fayade ofthe house must be forty-two (42)
inches in height or less." The purpose of the standard is to create a more pedestrian scale
to neighborhoods and avoid an entire block with six (6) foot high fences along the street.
APPLICANT: Coast Pacific Asset Management, Inc., represented by 80to Design
Architects. The application is included as Exhibit A.
LOCATION: 257 Park Avenue, Lot 3, Park-Dale Subdivision
ZONING: Moderate-Density Residential (R-6).
SITE DESCRIPTION: The applicant is requesting a variance from the Residential
Design Standards to allow a six (6) foot high fence on the comer of Park and Dale
A venues, where a fence no higher than forty-two (42) inches in height is allowed per the
standards. The proposed fence is setback eleven (II) feet from Park Avenue and seven
(7) feet from Dale Avenue. The applicant has included a site plan and elevations of the
proposed fence in Exhibit A.
REVIEW STANDARDS AND ST AFF EVALUATION: Pursuant to Section
26.222, in order to authorize a variance from the Residential Design Standards,
the Planning and Zoning Commission shall make a finding that Standard I or
Standard 2 is met.
In response to the review criteria for DRAC variance(s), staff makes the
following findings:

1. Review Criteria: Provide an appropriate design or pattern of
development considering the context in which the development is
proposed and the purpose of the particular standard. In evaluating the
context as it is used in the criteria, the reviewing board may consider the
relationship of the proposed development with adjacent structures, the
immediate neighborhood setting, or a broader vicinity as the board feels is
necessary to determine ifthe exception is warranted; or,
Response: The house is located in the R-6 zone district on a non-
traditional lot. Although the fence is setback from the street, this
neighborhood does not traditionally have tall fences along the street.
Although there are a few examples in the neighborhood of tall fences
surrounding properties in this neighborhood, it could not be called a
pattern, and in fact, many properties do not have fences at all, which
is partially due to the narrowness of Park Avenue. Staff finds this
criterion has not been met.
2. Standard: Be clearly necessary for reasons of fairness related to
unusual site-specific constraints,

STAFF RECOMMENDATION: Staff recommends that the Residential Design
Standard variance request to allow a six (6) foot high fence forward of the front fayade of
the building be denied finding the review standards have not been met.
RECOMMENDED MOTION (all motions in the affirmative): "I move to approve
Resolution NoJ-.~, Series of2005 granting a variance from Section 26.4IO.040(A)(3), to
allow a six (6) foot high fence forward of the front fayade of the house, finding that the
review standards in Section 26.4IO.020(C) have been met for 257 Park Avenue."

RESOLUTION OF THE PLANNING AND ZONING COMMISSION
APPROVING A VARIANCE TO THE RESIDENTIAL DESIGN STANDARDS
FOR SECTION 26.410.040(A)(3) FOR 257 PARK AVENUE, LOT 3, PARK-DALE
SUBDIVISION, ASPEN TOWNSITE, CITY OF ASPEN, PITKIN COUNTY,
COLORADO.
Parcel No. 2737-181-33051
WHEREAS, the Community Development Department received an application
from Coast Pacific Asset Management, Inc., owner, represented by Boto Design
Architects, for a variance from the Residential Design Standards for 257 Park A venue,
Lot 3, Park-Dale Subdivision; and,
WHEREAS, the property located at 257 Park Avenue is a 9,000 square foot lot,
located in the Moderate-Density Residential (R-6) Zone District, and currently has a two
single-family dwelling units; and,
WHEREAS, pursuant to Section 26.410,020 of the Aspen Municipal Code,
Community Development Department staff reviewed the applicant's application for
compliance with the Residential Design Standards of Section 26.410.040 of the Aspen
Municipal Code and found the submitted development application to be inconsistent with
Standard 26.41O.040(A)(3), related to fence height forward of the front fa<;ade of the
house; and
WHEREAS, Section 26.41O,020(C) of the Aspen Municipal Code provides that
if an application is found by Community Development Department staff to be
inconsistent with any item of the Residential Design Standards, the applicant may either
amend the application or appeal staffs findings to the Planning and Zoning Commission;
and
WHEREAS, pursuant to Section 26.41O.020(B) of the Aspen Municipal Code,
the applicant submitted a request for a variance from Standard 26.41O,040(A)(3) of the
Aspen Municipal Code to the Planning and Zoning Commission as it applies to the fence
height located forward of the front fa<;ade of the house; and
WHEREAS, all applications for appeal from the Residential Design Standards of
Section 26.410,040 must meet one of the following review standards in order for the
Design Review Appeal Committee or other decision making administrative body to grant
an exception, namely the proposal must:

WHREAS, during a duly noticed public hearing at a regular meeting on June 15,
2004 the Planning and Zoning Commission approved a variance from the Section
26.41O.040(A)(3) for 257 Park Avenue by a vote of _ to _ U to U,
NOW, THEREFORE BE IT RESOLVED BY THE CITY OF ASPEN PLANNING
AND ZONING COMMISSION, ALSO SERVING AS THE DESIGN REVIEW
APPEALS COMMITTEE:
Section 1
That a proposed variance to allow a fence of six (6) feet in height forward of the front
fayade of a house for a single-family residence at 257 Park Avenue, Aspen, Colorado, is
approved pursuant to Section 26.41O,020(C), of Residential Design Standards finding
that the review standards have been met
Section 2
All material representations and commitments made by the applicant pursuant to the
development proposal approvals as herein awarded, whether in public hearing or
documentation presented before the Planning and Zoning Commission or City Council, are
hereby incorporated in such plan development approvals and the same shall be complied
with as if fully set forth herein, unless amended by an authorized entity.
Section 3
This Ordinance shall not effect any existing litigation and shall not operate as an abatement
of any action or proceeding now pending under or by virtue of the ordinances repealed or
amended as herein provided, and the same shall be conducted and concluded under such
prior ordinances.
Section 4
If any section, subsection, sentence, clause, phrase, or portion of this Resolution is for any
reason held invalid or unconstitutional in a court of competent jurisdiction, such portion
shall be deemed a separate, distinct and independent provision and shall not affect the
validity of the remaining portions thereof.

Dear Joyce,
Thanks for your information related to the above variance request As per our discussion. I would formally like to
register my opposition to this proposal.
I drove through Aspen yesterday looking at fences, setbacks and transitions between residential and city
properties, I could find no instances of six-foot fences, and, in fact, few instances of four-foot fences bordering
residential properties, Even our largest homes have a lovely, floral transition from their property line to the street
This transition goes a long way to reduce the effect of the building mass and adds a real open quality to the
neighborhood, Contrast this approach to the walled, gated communities around Denver. The feeling is totally
different and not something that I would not like to take hold here in Aspen.
Due to its enormity, I have been opposed to the above-reference project from the get-go, Having said that, the
owners are doing a reasonable job landscaping the property and thereby softening its visual impact To allow a
six-foot fence around the property would violate, in my opinion, the residential design standards in place for our
community, I urge you not to approve this variance,

Rezoning or text amendment. Whenever the official zoning district map is in

2. APPLICANT uIlderstands and agrees that City of ..^",spen Ordinance No. 57 (Series of
2000) establishes a fee structure for Land Use applications and the payment of all processing fees is a
condition precedent to a determination of application completeness.
3. APPLICANT and CITY agree that because of the size, nature or scope of the proposed
project, it is not possible at this time to ascertain the full extent of the costs involved in processing the
application. APPLICANT and CITY further agree that it is in the interest of the parties that APPLICANT
make payment of an initial deposit and to thereafter pennit additional costs to be billed to APPLiCANT on
a monthly basis. APPLICANT agrees additional costs may accrue following their hearings and/or
approvals. APPLICANT agrees he will be benefited by retaining greater cash liquidity and will make
additional payments upon notification by the CITY when the), a..~ necessary as costs are inC\4'Ted. CITY
agrees it will be benefited through the greater certainty of recovering its full costs to process
APPLICANT'S application.
4. CITY and APPLICANT further agree that it is impracticable for CITY staff to complete
processing or present sufficient infurmation to the Planning Commission and/or City COWK:il to enable the
Planning Commission and/or City Council to make legally required findings for project consideration,
unless CU1Te1lt biiiings are paid in full prior to decision.
5. Therefore, APPLICANT agrees that in consideration of the CITY's waiver of its right to
collect full fees prior to a determination of application completeness, APPLICANT shall pay an initial
deposit in the amount of$/3~ which is for C houtS of Community Development staff
time, and if actuaJ recorded costs exceed the initial deposit, APPLICANT shall pay additional monthly
billings to CITY to reimburse the CITY for the processing of the application mentioned above, including
post approval review at a rate of $220.00 per planner hour over the initi.a! deposit. Such perlodk: pa)'Inents
shall be made within 30 days of the billing date. APPLICANT further agrees that failure to pay such
accrued costs shall be grounds for suspension of processing, and in no case will building pennits be issued
until all costs associated with case processing have been paid.

Variance Request Proposal

This proposal requests a variance to allow for a fence of 6'.{)" in height to be constructed along
the South and East sides of the property, starting from the edges of the existing buildings and
converging at the Southeast comer of the property. The fence and the site buildings have been
designed to appear as one cohesive element along both street faces. The fence will be
constructed from the same materials as the buildings and its height brings it into context with
other elements and buildings on the site, which will be seen from the street.
