Community Development Department's Comments on Draft
Plat
Please make the following changes to the draft plat:
I. Amend title to read as follows: "First Amended Plat of Lot 4, Maroon
Creek Club SubdivisionlPUD".
2. Include Vicinity Map.
3. Include the following purpose statement on the plat: "The purpose of
this plat is to amend the designated building and development
envelopes on Lot 9 of the Maroon Creek Club Subdivision and PUD.
4. Include signature blocks for the Community Development Director,
Community Development Engineer, Title Company, Owner's
Certificate, and a County Clerk and Recorder's Acceptance
Certificate.
5. Remove the notations that indicate parcel to be added (removed) and
replace with notation that indicates building envelope and activity
envelope area to be added (removed).
6. Obtain all signatures with the exception of the City Community
Development Director, Community Development Engineer, and the
Pitkin County Clerk and Recorder prior to submitting two (2) mylar
copies to the Community Development Department for recording. A
recording fee of $11 payable to the Pitkin County Clerk and Recorder
is due at the time of plat submittal. Additionally, a plat review fee of
$546 (payable to the City of Aspen) is due for review of the
amendment request.

Ae:reement for Payment of City of Aspen Development Application Fees
CITY OF ASPEN (hereinafter CITY) and
(hereinafter APPLICANT) AGREE AS FOLLOWS:
I, APPLICANT has submitted to CITY an application for
(hereinafter, THE PROJECT),
2, APPLICANT understands and agrees that City of Aspen Ordinance No, 57 (Series of 2000)
establishes a fee structure for Land Use applications and the payment of all processing fees is a condition precedent
to a determination of application completeness.
3. APPLICANT and CITY agree that because of the size, nature or scope of the proposed project, it
is not possible at this time to ascertain the full extent of the costs involved in processing the application.
APPLICANT and CITY further agree that it is in the interest of the parties that APPLICANT make payment of an
initial deposit and to thereafter permit additional costs to be billed to APPLICANT on a monthly basis.
APPLICANT agrees additional costs may accrue following their hearings and/or approvals, APPLICANT agrees he
will be benefited by retaining greater cash liquidity and will make additional payments upon notification by the
CITY when they are necessary as costs are incurred. CITY agrees it will be benefited through the greater certainty
of recovering its full costs to process APPLICANT'S application.
4. CITY and APPLICANT further agree that it is impracticable for CITY staff to complete
processing or present sufficient infonnation to the Planning Commission and/or City Council to enable the Planning
Commission andlor City Council to make legally required findings for project consideration, unless current billings
are paid in full prior to decision.
5. Therefore, APPLICANT agrees that in consideration of the CITY's waiver of its right to collect
full fees prior tq a detennination of application completeness, APPLICANT shall pay an initial deposit in the
amount of $ 00 which is for ':~),,' '. hours of Community Development staff time, and if actual
recorded costs exceed the initial deposit, APPLICANT shall pay additional monthly billings to CITY to reimburse
the CITY for the processing of the application mentioned above, including post approval review at a rate of $205,00
per planner hour over the initial deposit. Such periodic payments shall be made within 30 days of the billing date.
APPLICANT further agrees that failure to pay such accrued costs shall be grounds for suspension of processing, and
in no case will building penn its be issued until all costs associated with Case processing have been paid.

As you know, our firm is counsel to the Maroon Creek Club Master Association
(Association). This letter was prepared at your request regarding a pending sale of Lot
4.
Pursuant to the meeting between you, as representative olL W Development, Gary
Albert, President of the Association, Andy Hecht, as both a legal representative of the
contract purchaser of Lot 4 and as a SARC member and myself, this letter constitutes the
response of the Association to the requests that you have made for supplemental approval
regarding the modification of building envelopes, variances from the Approval for Lot 4;
and conditions for subsequent review and Approval oflandscaping conditions:
Building and Development Envelope Modifications. The proposed
modifications to the Building and Development Envelopes from the existing
description of same (as shown on the Final Subdivision Plat & PUD for
Maroon Creek Club recorded in Plat Book 33 at Page 4) to the descriptions

shown on the Improvement SUlVey Plat prepared by Tuttle SUlVeying
Services on March 25,2004 for Lot 4 is APPROVED, subject to:
a. the further modification of the Building Envelope described
In 2. below;
b. the prior approval by the City of Aspen, Community
Development and Building Departments of the Building and
Development Envelopes set out in this paragraph 1. and in
paragraph 2. below (with evidence of same to be provided to
SARC); and
the compliance of the installation of all air conditioniruz
equipment with the new applicable Association Guidelines,
Retaining Wall at western boundary of Lot 4. The existing retaining wall
at the western boundary ofLot 4, though not strictly in compliance with the
Approval for Lot 4 and the Design Guidelines is APPROVED AS AN
ADMINISTRATIVE VARIANCE, subject to:

the modification of the Building Envelope to incorporate the
retainiIlR wall without increasing the overall size of the
Building Envelope; and
b. the prior approval by the City of Aspen, Community
Development and Building Departments of the location of the
retaining wall (with evidence of same to be provided to
SARC).
3. Anodized Metal Roof Trim (Brown). The use of anodized brown metal
roof trim, though not in compliance with the Approval for Lot 4 and the
Design Guidelines, is APPROVED AS AN ADMINISTRATIVE VARIANCE,
subject to PAYMENT OF A FINE OF $500.00.
4. Entrance Chandelier and Down Lighting. The installation of a Chandelier
which was not included in the Approval and is in violation of the Design
Guidelines, is DENIED and the Chandelier must be removed. The use of
down lighting that was not part of the Approval and does not strictly comply

with the Design Guidelines is APPROVED AS AN ADMINISTRATIVE
VARIANCE.
5. Incomplete Landscaping. AIl incomplete landscaping, excluding the
retaining wall described in paragraph 2. above (and resolved in that
paragraph), must be:
a. timely completed in accordance with the requirements of the
Master Declaration of Covenants for Maroon Creek Club (recorded
in Book 733 at page 599), the Approval, the Design Guidelines and
applicable portions of the letter from William Lukes + Associates
dated April 30, 2004;
b. inspected and approved by William Lukes + Associates;
c. In compliance with all City of Aspen requirements contained in the
Certificate of Occupancy issued by the City and completed as
specified therein by June 30, 2004. Proof that the City has inspected
and approved the completion of said requirements will be provided
to SARC; and
d. assured to be completed by the immediate renewal of the Letter of
Credit in the amount of $100,000.00 to secure the peIformance of the
Landscaping under the Maroon Creek Club Construction Guaranty.
6. Gravel Driveway, The use of a gravel access driveway has also been
APPROVED AS AN ADMINISTRATIVE VARIANCE.
