Aspen, Colorado - Informal Meeting - Aspen City Council May $, 1961
Mayor Garfish, Councilmen Braun, Anderson and James and City Administrator Wurl
met informally with Judge Shaw and Edgar Stern at 5:00 PM, the purpose of the meeting
being to discuss water in Castle Creek.
Mr. Stern referred to an old water right, and said he does not know if it is still
. good, and that his lawyer had suggested that he seek a point for change of diversion,
~ Stern- to carry water into City's flume, and pay his prorated share of maintenance of flume.

Creek Judge Shaw said that by permitting him to use flume h? would have a 30th interest
in the City's flume, ditch and water rights - a matter of znterest to City.
DiscusSed requirement that notice be given before any change in point of diversion,i
any contract with City should have waiver of claim on ditch or flume, and that City
could not be bound due to possible need for full capacity of flume.
Judge Shaw suggested rental agreement -~as the City cannot guarantee carrying
capacity at all times, and a waiver of all demand for interest in ditch water. Stern
could be permitted to use so many cubic feet of water at a reasonable rental and with a
6 month notice of termination of agreement.
Mr. stern estimated he would need about one second foot of water. He said he was
agreeable to a contract with the City with cancellation clause, and he Will follow
up on his possible water rights. Judge Shaw suggested Mr. Stem's lawyer, Mr. Danielson
contact him about the agreement and discussion on change in point of diversion. Stern
will need water b~ the middle of June.
It was decided that Judge Shaw should proceed with the matter of the lease direct
with Mr. Stern, and he will deal with Roy and Dart who are also interested in getting
water. The yearly rental will be $265.00 with cancellation privil&ge.
Mr. Stern agreed to let City put pipe in flume.
It was de6ided to confirm the appointment of Norris Taylor to the Adjustment Board
N. Taylor at the next regular meeting.

There is to be a meeting on East Aspen Patent on May 8, at 7:30 PM.
Mayor Garfish instructed Clerk to send bills from the Hotel Jerome for fire calls
Bills- Fire to the Fire District.

Councilman Anderson said he had seen a man named Harmon who has been hired by
~ Gas Gathering Co. for advice, and he had suggested City look very carefully into
Rocky Mountain contract.
