HomeMy WebLinkAboutminutes.council.19610605 Mayor Garfish called the meeting to order at 7:30 PM with Councilmen James, Ander- son, Braun, and Beyer, City Treasurer John Hall, City Administrator Wurl and City Attorney Stewart present. The minutes of the regular meeting of May 15 and the recessed meeting of May 29 Correction were read and the following oorrection noted - change "fix tank or supply a pump" to Minutes "fix tank and supply a pump". A motion was then made by Braun, seconded by Beyer,to approve the minutes as corrected. Carried unanimously. '<.7 Discussed - supplying water to Red Mountain. The Accounts Paykble of the City and the Special Water Fund were then read and dis- cussed. A motion was made by Anderson, seconded by James, to suspend Rule 19 and pay the amounts. Carried unanimously. The Treasurer's report was read by John Hall and discussed, and Council agreed that the~form used, showing the actual cash balance, is good. The-transfer of funds from the Electric Contingency Fund in the amount of $8000.00 to the Special Water Fund(now in C. D.'s) will be handled by the Pitkin County Bank, with notification to the Clerk, and Hall will follow up. A motion was made by Anderson, seconded by Braun, to accept the report as read. Carried unanimously. Mr. Singer said the Music Associates would like to present free concerts in the Bell 0oncerts Tower in Paepcke Park for the public. He gave a brief report of the Festival and the Bell Tower School. The matter of the floor of the Tower and liability insurance were discussed~ and Wurl will handle. Mr. Beatty of the Public Service Co. asked that legal notice as to further consider- ation of ordinance granting franchise to the Public Service Co.of Colorado, published Public Serv. in the Aspen Times, be read and ordered placed with the minutes. DiscuSsion followed Co. regarding election in Glenwood Springs on June 27th, and whether to consider franchise at the regular meeting of 3ulyJor at an adjourned regula~ meeting after June 27th. A motion was made by Anderson, sec~xled by Beyer, that the Council postpone consider- Motion etlon of the proposed~gas franchise of Public Service Company until the first regular gas meeting in July, which will be held July 3, 1961. C~rried unanimuosly, franchise A motion was made by Anderson, seconded by Beyer, that the Council postpone con-. sideration of the proposed gas franchise of the Rocky Mountain Natural Gas Co. until July 3, 1961. Carried unanimously. There being no further discussion on franchises, the representatives of both com- panies then left the meeting. The City's application for a Housing and Home Agency loan was then discussed, and additional information has been requested and furnished. Mr. Balanger reported to Council St. Grade on the street grade program, and said he had contacted Mr. Green of the State Highway Program Dept. as to work to be done on Route 82 a~Cooper and Main Sts. RegardinM statements, it was decided that they would be payable as submitted after approval of loan. Mr. Balanger said they would like to be considered for construction supervision if work is done after the grading program is completed. Bob Card referred to the two dead-end Streets -Hyman and Cleveland, and asked if Card- they could be put back into good condition, and the culvert replaced. Wurl will follow up. Mr. Stewart said Mr. Buchanan is to furnish accurate description of the location of Description the new pumphouse on Hyman, and he will check this.i location- pumphouse. Bert Bidwetli~said he had a problem in connection with underground cable for power for his house, as switchbox cannot be put on pole now in alley. .The possibiity of having Bidwell- a secondary pole set to take box was discussed, and Wurl will see if this can be donm, witt pole for the owner maintaining and replacing the pole when necessary, power line Mr. Gross, Attorney for the Nugget, was present, and Mr. Garfish read a letter from Attorney Stewart, which reads in part, "Today Mr. Wilson from the State Liquor Department was in my office with the local inspector, Paul Adams. This matter was dilscussed and the information transmitted to me is that the City Council should deny this license on the basis that the proposed restaurant lies within five hundred feet of the school measured by t~he distance between the nearest property lines which is less than 500 feet". Inasmuch as Jim Snobble was not at the meeting, having been informed that nothing new had come up, a motion was made by Beyer, seconded by Anderson, to again table this matter. Carried un- animously. Jim Markalunas reported that he had measured the Council Room, and according to the Council Room Fire Code, the two doors should swing out,- there should be "Exit" lights over the doors, doors-exits. and the lock on the front door of the building should be changed, and ther~, should be an exit door in the main building where the sliding door is located. A motion was made by Braun, seconded by James, to authorize Mr. Wurl to reverse the doors in the Council room, have exits signs put up and to change~the lock. Carried unanimously. Discussed - complaints that Mr. Hurst is conducting business in residential zone, Hurst- but no one will file complaint, and extent to which ordinance may apply. Hans Graemigger asked if Fritz Benedict had asked for water service to Aspen Grove, Benedict- and suggested this might be an opening for annexation. Mr. Wurl referred to Ordinance No. 6, Series of 1954 re weed and trash removal, and Trash asked if specific authorization from Council is required. Attorney Stewart suggested Ordinance that Wurl get all the facts and again refer to Council for direction. Names of owners enforcemen~ of vacant lots are on file in the Court House, in the Assessor's Office. It was suggested that the Police D~partmentcheck on business places. Wurl said he *and Mr. Stewart had discussed communication from Bureau of Reclama- Ei~ctric tion regarding power, and asked for authorization to write regarding reduction in Rates rates. A motion was made by Beyer, seconded by Bra~n, authorizing Wurl to send letter to the Bureau of Reclamation re City purchase of power. Carried unanimously. Colo.River Mr. Wurl referred to membership in the Colorado River Basin Consumers Power, Inc.. Basin Cons. Mr. LeCuyer represents Holy Cross and some others, and Wurl suggested he might be em- Power Member- powered to represent the City. He will contact Mr. LeCuyer to see if he will be wil- ship ling to do so, as the Council is agreeable to this. M~. Stewart referred to the possibility of using the combined water power to put Water power in a power plant near Shale Bluffs~ and in this way make use of the water. It was disc. suggested that a letter go to the Colorado Water Conservation Board for a report on feasibility. This was discussed-together with the Soil Conservation program. Wurl is to contact Oreste Gerbaz. Leasing Also discussed - leasing water on Maroon Creek. Wurl had discussed this with Water Judge Shaw, who told him that if the City authorized any work by property owners, City would be in a position of implying that they had rights. He also talked to Mm. Delaney who will contact Judge Shaw. Further discussion followed/8~ncrete plan, value of water rights, whether ~it is justified to spend taxpayers money to conserve all of water. A meeting with Les Finley was suggested, and Mr. Stewart will arrange. Mr. Stewart said Nell Edstrom was concerned about water seepage and this was discus- sed. Aspen Skating Rink suit still pending. East Aspen East Aspen Patent - Mr. Stewart suggested calling expert witnesses, and Councilman Patent. Anderson will see if John Vanderwelt is available. Annexation - Ute - still pending. Lots claimed by Wieben and lots in Paepcke Park still pending. Contractor's Contractors' license ordinance discussed - Wurl referred to fees outlined in Muni- Ord. cipal League publication. He and Markalunas will work on this and it will again be presented at next meeting. Ord. No.7 Ordinance No. 7, Series of 1961, an Ordinance Providing for a License for the En- 1961 gaging in any Vocation, ~ccupation or Business in the City of Aspen, Providing for Ex- emptions from Such License:Providing Penalties for Violations Thereof and Declaring an Emergency to Exist, was then read by Attor~aey Stewart and discussed. It was suggested that a provision be added to cover that it is effective this year. A motion was made by Braun, seconded by James, to approve as read with corrections and to order published. Water~orks amendment ordinance discussed - also tip count on residences adjust- ment in commercial electric rate postponed for report from Mr. LeCuyer. Ord. No. 8, Sez les Ordinance No.~8, Series, 1961, an Ordinanc~ Amending a Portion of Section 29, %961 Ordinance No. 1 (Series of 1960) relating to Meter Rates and Charges and Amending Section 47, Said O~dinance No. 1, Providing for Tap Charges for Water Users Within the City of Aspen and Outside the City of Aspen, was then read by Attorney Stewart and discussed, and "per 1000 Gals." is to be included in rate structure, with changes made in some rate4. A moti~on was made by Anderson, seconded by Beyer, to approve the ordinance with the changes, and to order it published. Carried unanimously. Discussed - wasting water and permitting sprinklers to run all night. Mr. Stewart is preparing information on the matter of Roy Reid fence. Mr. Stewart referred to the drainage problem at the Eagles Club, and Mayor Garfish Drainage said an electric pole in the alley was adding to the difficulty. Also discussed - 6ulvert at Toms's market, and Wurl suggested putting in fill Bealmear to stop flow, - advantages of open drains,- hole under pump house and means of filling-. it.
