R( Aspen~ 0olorado Special Meeting, Aspen °ity Council May 2~ 1962 Tenney com- plaint against Mayor Garfish opened the special meeting at 5:00 PM with Councilmen Neweil, Bldg. Inspector Moore, Beyer, and Zordel, Bldg. Inspector Jim Markalunas, City Attorney Stewart, CityAdministrator Humphrey, and Mr. William Tenney present. Mr. Tenney said he had been reported to the State Inspector by Markalunas. He also said he had not seen letter sent addressed to him by the Building InspectOr, certified mail, and signed for by E. Tenney, Mayor Garfish read copy of letter to Council, wherein_violations were pointed out and a i mit of time'given for correction, and wherein it was Stated that a motel license for Timberline Dormitory could not be issued until safety requirements had been met. M~Te~ney said that he would sue the City for $250~000.00 unless Jim Markalunas was fired. Discussed - violations, and Jim s~id he had informed Mr. Tenney of the conditions when he made the inspection. Tenney said he had contacted Clyde Clymer but work had not yet been done. Jim said he did not contact State Inspector, but when he came into the office, he had shown him copy of the letter sent to Mr. Tenney. - duties of Building Inspector- and Jim.asked for statement of policy from Council, also who is fire inspector? -Mr. Tenney re~erred to Prince Albert and Roaring Fork Buildings. Council suggested that refer such cases to them before sending out formal notices. A~Drney Stewart referred to Building Code, and said such cases could be refer- red to Board of Appeals by the property owner. He also said Council policy could cover - Type of~letter to be sent. Violation should be pointed out and specified. Reference to "vacating" could be deleted. <-~ Old buildings - program should be worked out between owner and Jim (Bldg. Inspector), and presented to Board of Appeals, so that matter of improvements can be worked out. Markalunas said he and Mr. Humphrey had consulted Don Elisha and they have started on a program. Mayor Garfish referred to letter sent by Building Inpsector regarding Briggs trailer house, and Jim outlined violations. He said, as Building Ispector, he felt he is responsible for public safety. 170 Aspen, Colorado Special Meeting, Aspen City Council May 24, 1962, Con~'d. Recommendation by Attorney Stewart - City has Ordinance relating to these matte rs, and Building Inspector must be guided by m/les outlined - there is a Board of Appeals but so far this has not been used;- he also referred to moral responsibility of City~ and suggested that Council and Building Inspector and owner prepare program to be referred to the Board of Appeals, and Board members should be notified.~ Mr. Stewart said he would talk with Tom Sardy,&Attorney Delaney, who represents the Aspen Company, about the Brand Building. It was suggestd that 3im inspect Roaring Fork and Prince Albert buildings, and he will do this. Discussed - well at east end of Hyman St. -has shifted again, and Council agreed to having pumps moved from Well no. 1 to Well No. 3, and from Well No. 3 to Well No. 4. The meeting was adjourmed at 6:30 PM.
