HomeMy WebLinkAboutminutes.council.19640302 Aspen, Colorado Regular ~eeting Aspen City Council March 2, 1964 The regular meeting was opened by Mayor Pabst at 4:00 PM, with Councilman Barnard, Kuster, McEaGhern and Stapleton, City Attorney Balcomb, City Admini§- trator Kerrigan, and ~ity Treasurer Lum present. The accounts payable w~re given to Councilman McEachern to check. The minutes of the previous meeting of February 17, 1964, were approved as read. Attorney Stewart, for Mrs Sparovic~ showed plat of area for which the Deed - Sparovic's are requesting deed underthe East Aspen Patent. After discussion Sparovic. a motion was made by Councilman McEachern. seconded by Councilman Barnard, to authorize the Mayor to execute a deed to the Sparovic's after description has been checked against the area indicated on the plat presented. Motion carried on roll call - Councilmen Barnard aye; Kuster aye; McEachern aye Stapleton aye. Councilman McEeche~n then reported the accounts payable to be in o~der, afd a motion was made by Councilman Barnard, seconded by Councilman Stapleton, to suspend Rule 19 and to allow the several amounts. Motion carried on roll call: Councilmen Barnard aye~ kuster aye; McEachern aye; Stapleton aye. Liquor licenses Tabled liquor licenses - Tabled Independence Building - plans and specs not received. Smuggler Motel - until meeting of April 6th. Annexation Petition - Block 2 Eames Addition Ordinance No. 1, Series of 1964 - Ord. 1, Corrected plat and petition not yet received. 1964 - Annexation petition - Roy Vroom for Mrs. Dorothy Shaw - part of Block 19 - to be B1 19. referred to Planning ommlsslon for report for next Council Annexation meeting. Electric System rebuild - Discussed - publication for final payment - warranty period ~ Blectric and responsibility, rebuild. City Administrator Kerrigan is to contact Merrick and Co. regarding having a repre- sentative here to clear up all matters, including faultylconstruction, with Council. Ordinance No. 5, Series of 1964, -(Vaccination and Impounding of Dogs)- An Ord. 5 Ordinance Providing for the Vaccination and Licensing of Dogs; for the Impounding 1964 and Disposition of Unlicensed Dogs; for the Repeal of Prior Ordinances oh the Same Subject Matter; and Declaring an Emergeny to Exist, - was read in full for the second time by Attorney Balcomb, and accepted and finally adopted upon motion by CoUncilman Barnard, seconded by Councilman Stapleton, and passed on roll call: Councilmen Barnard aye; Kuster aye; McEachern aye; Stapleton aye. Attorney Balcomb: Sales Tax opinion. He had received letter and sample ordinances from Sales Tax. the Colorado Municipal League and suggested Council look these over. Discussed- cost of litigation. Council to study sample ordinances. Molly Gibson liquor license suspension - Order of Stay of Execution discussed Molly Gibson and case will come up in District Court on Thursday, March 5, 1964. Discussed. Stay of Execution. Councilman Barnard referred to Wonder Shop windows ~ecently broken, and asked if Council may file charges. Attorney Balcomb advised that, if facts gathered by Polic~ Wonder Shop Department are sufficiently strong, complaint may be filed in District Court. Council also discussed with Mr. Walls and Mr.Whitaker - interpre~tion of Official Official Code, and discrepancies. Code Tri-C6unty'Planning Commission - Attorney Balcomb said he had discussed this Tri-County with the attorneys of the other entities, and nothing definite has been decided, and Planning Comm he does not feel that Council should act before the others present their plans. After discussion, a motion was made by Councilman Barnard, seconded by Councilman -Kuster, to turn this matter over to Attorney Balcomb to draw up an Ordinance. Motion carried with all Councilmen voting "aye". City Administrator Kerrigan- Dog ~Control. The agreement with David Mullikin, Agmeement Mt. Sneffels Kennels, was read by Attorney Balcomb~ and a motion was made by Dog Catcher Councilman McEachern, seconded by Councilman Stapleton, to authorize the Mayor to execute the contract. Motion carried with all Councilmen voting "aye". Mr. Kerrigan reported that all CoUncilmen had met with Dale Rea, and had di- Water plans. rected Rea to investigate and draw up plans and specifications for a long range water plan. He outlined plan for providing additional water for the summer, and said negotiations are under way to obtain additional water rights on Hunter Creek. Dump - Mr. Kerrigan has talked with the County Commissioners on this matter Dump and they agree that it is a joint operation. Discussed - need for new location and type of operation to be adopted. He said Victor Goodheart will continue trash col- lection operation pending execution of a new contract. Bill Dunaway inquired about the number of publications required under the Liquor App'l. Liquor Code on new licenses, and Attorney Balcomb advised that one would be suffic- Posting and ient. Motion carried with all Councilmen voting "aye''~ George Madsen referred to Chamber of Commerce dues and asked that the City Contributions contribute the previous amount of $250 8r increase it to $500.00.
