HomeMy WebLinkAboutminutes.council.19661024Special Meeting Aspen City Council October 24t 1966 Meeting was called to order by Mayor Robert Barnard at 5:25.p.m. with Councilmen David E. Stapleton, Werner Kuster, William McEachern, Clyde Clymer, Provisional City Attorney Gaylord, City Administrator Leon Wurl. Mr. Oglavie from the Bureau of Reclamation was present and-showed sketches Road up Hunter and explained the route from Aspen to Meredith which is under construction. This Creek. would be an advantage.to Aspen~ which will provide an alternate route up Red Mountain, and will give better access ~o Hunter Creek~ Objections to the route were voiced by people whose property is not affected, have had excellant copperation from those whose property will be crossed. Road will be surfaced and begins at the City boundary~line between the Smuggler Trailer Court and Alice Lane. There will be no interference with existing water rights on Hunter Creek. Councilman Werner Kuster left Council Chambers. LITTLE BAVARIA, INC. - Councilman Stapleton moved to issue a liquor license to the Little Bay. Little Bavaria, Inc. Seconded by Councilman McEachern. Roll call vote - Councilmen Liquor Lic. Stapleton aye; McEachern aye; Clymer aye. WHEELER OPERA, HOUSE THEATRE BAR - Councilman Stapleton moved to gi~e the l~quor Wheeler Opera Ho~e license to the wheeler Opera House Theatre Bar. Seconded bY Councilman McEachern Liquor License Roll call vote - Councilmen McEachern aye; Clymer m~y; Stapleton aye. WIENER STUBE - Councilman Stapleton moved to accept the application on the Wiener Wiener Stube Stube. Seconded by Councilman McEachern. Councilman StaPleton - I would like to say one thing now, with the applicants Speak by Stapletpn that are here now, As you well know, this is one trying dam thing to find out whether the needs of the neighborhood have been met, or whether they aren't being met, or what. I want to make it clear, and I would like. to make this a part of the minutes, Lorraine, That I am not going to be against any liquor application on liquor license as long as it complies with the laws that are established by the City Council and also by the State Liquor Licensing Authority. I am, however, going to take a good strong look at these liquor licenses at renewal time in regards to sanitation facilities and police reports. And if these things are not up to order and standard at the time of renewal on these licenses, then I am going to be the first to make a recommendation that they be taken away. · Speech by Mayor Mayor r As long as we are talking about these liquor licenses, % would like to propose an idea to Council and also anyone in the room, the bulk of our problems in connection with liquor licenses comes from the shoe string fly by night operators. I would like to make this proposal to you, just an idea to plant a seed, the idea .is virtually this, I would propose that every liquor outlet what- ever kind it might be would put up in cash in escrow or a bond which wnuld con- stitute the same thing, let us say $5000. This money would be made available to all the suppliers so that anybodys bill that~ was not paid within 30 days, then b' that money could be su 3ec.t to whatever bills that are against him. You might. say that this is a funny thing to do, but if you think about this for awhile, you see that it is not so funny. You do abou~ three things here. You would protect the suppliers so you wouldn't have this business of everybody being delivered COD, which I happen to know is pretty much ~the case right-now, two you would immediately get rid of the shoe string operators because they simply wouldn't want to put that much money into this business, three you would not protect individual operators, but you would protec.t the community so that a good successful operator would have a major protection against having the nickel and dime operators come in and chip away at them, which is exactly what we have had to contend with here within the last three years that I have had with the Council. This is just a thought, I am not saying that it is the best idea in the world, but i do think this, If we are honest with ourselves, we will realize one that we have not been able to make anything that remotely resembles a liquor policy, two this would be a way that anyone in the. liquor business would have to pay to play. Before you throw rocks at the idea, stop and think about it a little bit and see if maybe there isn't some merit in this idea. Speech by McEach rn Councilman McEachern - I think in the first place, we have had a liquor policy ever since our ~opening fiasco when we tried the policy pf containment and got in over our heads, and that is everybody that was financially able and obviously setting up a good place, our policy became, at least it has been for the last 2 years, to grant a license. The more I think about it, in spite of what Dr. Barnard said last week, I can't see why the liquor license is the primary thing. I see it as an accessory, you can't tell me that someone goes to the Crystal Palace because the liquor is better there than at~itheaAbbey or s. omeplace else. They go there because the food and entertainment and I think as far as one place having success then the other, the management, type of food and proper operation of the establishment is what is decided and not the liquor license. I don't think people in Aspen go out primarily to drink at night, I think they go out to eat and that is something along with $~e~meal. But I sure agree withDave, when renewal time comes up some of the places that have been having some trouble better look out,- because once they are granted as far as I am concerned they are going to run first class, or they will be denied. Tom Benton gave a report On the proposed mall for Hyman Street. Poll of the ~ Mall on Hyma~ businesses is practically complete. Have 12 more businesses to contact. Council agreed if poll comes out with a 2/3 rds favorable vote, Wurl is instructed to proceed. Water Line - Council agreed to extend the water line west to Shale Bluffs, with a Water Line We~ t 14" line to Buttermilk continue with 10" to the airport. Cost would have to be borne by those wanting the extension. Councilman Stapletnn moved to adjourn at 6:00 p.m. seconded by Councilman McEachern. All in favor, meeting adjourned.
