The accounts payable were given to Councilman Clymer to check. Councilman Kuster made a motion to approve the minutes of August 6, 1968 as mailed. Seconded by Councilman Bergman. Roll call vote - Councilmen Clymer aye; Kuster aye; Bergman aye. Ord. #29 Segl ORDINANCE #29, SERIES 1968, AN ORDINANCE AMENDING TITLE XI, CHAPTER 1, OF THE ORDINANCES Zoning OF THE CITY OF ASPEN, COLORADO, PERTAINING TO ZONING TO PROVIDE ZONING FOR THE AREA ANNEXED TO THE CITY OF ASPEN, COLORADO, BY ORDINANCE NO. 22, SERIES OF 1968, AND DECLARING AN EMERGENCY TO EXIST was read by title only, as agreed by Council, on second reading by the City Clerk. Councilman Bergman made a motion to adopt Ordinance #29, Series 1968 and order same published. Seconded by Councilman Clymer. Roll call vote - Councilmen Kuster aye; Clymer aye; Bergman aye. Public House Public House - Purchase and Sale - Councilman Clymer made a motion to approve the purchase Purchase & Sale and sale liquor application for the Public House to Donald James Hamouz. Seconded by Councilman Bergman. Roll call vote Councilmen Kuster abstain; Bergman aye; Clymer aye. Motion carried. Councilman Kuster made a motion to schedule a public hearing on September 16th 5:00 p.m. to consider including the C-C and RMF Zones under building review. Seconded by Councilman Bergman. Roll call vote Councilmen Bergman aye; Kuster .aye; Cl~vmer aye. Stock Transfer - Paul's Liquor - City Clerk rePorted all was in order. ~Copies sub- ~aul's Liquor mitred to Council. Councilman Kuster made 'a motion to grant a transfer of stock in Paul's liquor to Thomas Iacono. Seconded by Councilman Clymer. Roll call vote - Councilmen Clymer aye; Kuster aye; Bergman abstain. Motion carried. ~ Planning and Zoning Appointment - Mayor Barnard reported letters had been received from & Z Appoint. Dale Mars and John Dukes. Councilman Bergman made a motion to appoint Dale Mars to the Planning and Zoning Dale Mars Commission. Seconded by Councilman Clymer. Roll call vote - Councilmen Bergman aye; Clymer aye; Kuster aye~ Police Magistrate - App~ilntment - Mayor Barnard reported letters had been received from Leonard Oates - present I~ep~ty Police Magistrate and William Tharp who are interested Magistrate in serving the City as Police Magistrate. Oates Appoint. Councilman Kuster made a motion to appoint Leonard Oates as Police Magistrate and A~ministrator Wurl is instructed to stipulate the Police Magistrate's terms of employment by letter. Seconded by Councilman Bergman. Roll call vote - Councilmen Kuster aye; Clymer aye; Bergman aye. Election Expense - LiSts of the expenses were submitted to the Council by the City Clerk including the expense of Judges and Clerks, Polling Places and Canvasser. Sales Tax Elec. Councilman Kuster made a motion to approve payment of the election expenses as submitted by the City Clerk. Results of the election held August 6, 1968 as follows were read by Mayor Barnard: FOR the question 164 AGAINST the question 195~ Parking lease - Administrator Wurl submitted to Counc£~'a form to be used for leased Par'king Lease parking spaces from the City for Council approval. Form prepared by Attorney Roan. Administrator Wurl stated upon determining an amount to be charged, would again : need Council approval, i~,~ Councilman Kuster made a motion to approve the lease form as submitted. Seconded by Councilman Bergman. Roll call vote - Councilmen Bergman aye; Clymer aye; Kuster aye. Mayor's Cup - Administrator Wurl presented to the Council the Mayor's Cup which was Mayor's Cup Golf won by the City at the golf-tournament. Sales Tax - Administrator Wurl reported he and Attorney Delaney had been appointed by the County Commissioners to prepare a Resolution to provide for a 2% sales tax Sales Tax on the November ballot. Councilman Clymer made a motion to instruct City Administrator Wurl to help Attorney Delaney in the preparation of a Resolution calling for a 2% County sales tax based on the tax being divided on the base of collection. Seconded by Councilman Bergman. Roll call vote - Councilmen Clymer aye; Bergman aye; KuSter ayef Migel vs. Leon Wurl and others. Administrator Wurl reported he and a portion of the Hippie Case Police Department will be going to Denver to appear in the U, S. District Court. Mayor Barnard request the City Administrator talk to Corn Construction concerning fixing the defects in the 1966 paving. Administrator Wurl to handle. Council questoned a complaint on the horses on Cooper morning and night from Anderson stables ea~ing the flowers along the way. Administrator Wurl to talk to Anderson Stables. Labor Day - Council Meeting - Councilman Kuster made a motion to schedule the next Labor Day regular meeting of the City Council on Tuesday, September 3rd due to the holiday. Seconded by Councilman Clymer. Ail in favor, motion carried. Cross Walks - Administrator Wurl reported the State will repaint the cross walks on Corss Walks Main Street prior to the beginning of school. Alleys - Paving - Administrator Wurl proposed the City pave only 2 alleys. Suggest Alleys ~ the City do a count and do the two busiest alleys. Councilman Kuster made a motion to approve the paving of the 2 busiest alleys. Second- ed by Councilman Bergman. August 197 1968 Magistrate Meyer Letters from the following were read by Administrator Wurl and Mayor Barnard relating to the removal of Police Magistrate Meyer and the undesirable element: Lester Putm~n, Leonard Stein, Ray Dudley, Warren Phalser. Administrator Wurl reported Ron Halbert, Aspen Police Officer, had graduated from police training school as 3rd out of 37 attending. Administrator Wurl reported as a preliminary estimate to put the electrical underground in the business district would be $259,170.00. Audit Audit Report - Copies were submigted to Council. Administrator Wurl to submit to the Council copies of the transmittal letter. William Dunaway reported one of his employees had received a ticket for parking in front of the Hotel Jerome where the No Parking signs are. Council instructed Administrator Wurl to have the signs removed. Budgets - Proposed budgets by the department heads were submitted to Council as follows: Budgets Board of Adjustment - Council made no comments. Total budget S700.00. Planning & Zoning - Administrator Wurl reported this budget is submitted on the same basis as 1968, consulting planner basis. Rough outline of the proposed capital outlay items by the Planning and Zoning were read by Administrator Wurl as follows: ~1 - Parking Facility ~2 - Storm Sewers #3 - Beautification Program, malls #4 - Parks, swimming pool, golf course, tennis courts #5 - Further Study Projects Water rights City-County building or City Hall Building Transit System Fire Station Acquire Gas~Utility Electrical Underground Finance Department - Administrator Wurl reported this budget reflects 1/2 the cost of the IBM equipment at the Chamber. Budget $54,587.00. Police Department - This budget includes the dog catcher plus 9 officers and the Chief. Building Inspector - This account was previously split between the City and County, Total budget S16,167.00 Treasurer - No comments. Police Magistrate - Administrator Wurl reported he has proposed an increase in the salary of $100 per r~nth. Councilman Kuster reported he felt an increase of $50.00 would be sufficient. Fire Protection - No comments Legal - No comments Tourism - Administrator Wurl reported the salaries will be paid out of Chamber funds. Council agreed this budget should have a ceiling of $50,000. Administrator Wurl to re-submit this budget again. Streets - The budget includes a sidewalk program of the downtown ares, Cooper Street and Main Street out to Third. Total budget of $182,306.00. Sanitarian - Administrator Wurl stated this budget includes the maintenance and payment on the dump. Discussed the disposal of junk cars. Administrator Wurl reported he had discussed with the County Commissioners putting in a duplex and well at the dump for the maintenance man and possibility locating the dog catcher and pound at this site. Council - Administmator Wurl reported under this budget he had provided for an increase in the Mayor's and Councilmen's salaries and also provided for the additional Council men under Home Rule. Increased Councilmen to $100 per month and Mayor $150. Council agreed this budget be based on no increase in salary only provide for the additional Councilmen. 818 Regular Meeting Aspen City Council August 19, 1968 City Clerk - Wurl reported this budget has proposed a microfilming system and provides Budgets for 4 Home Rule Elections. ' ' City Engineer - Wurl reported this budget provides for buying some of the equipment the City now pays a rental charge for to the City Engineer. City Administrator - This budget provides for an increase in salary the first of the year of $100 per month. Councilman Kuster made a motion to increase City Administrator Leon Wurl's salary S100.00 per month beginning August 1, 1968. Seconded by Councilman Bergman. Roll call vote - Councilmen Bergman aye; Kuster aye; Clymer nay. Motion carried. Salary increaseof S100 the first of the year was also approved by Council. Administrator Wurl rep&rted the budget is much easier to prepare due to the interest shown by department heads in reporting what they feel their departments require. Administrator Wurl request Council think about 2 additional holidays for City Hall Washington's Birthday and Columbus Day. Administrator Wurl submitted 2 bids for paving of the alleys as follows: Alley Paving Bids Mountain States Paving $10,854.00 Corn Construction 10,216.00 Bids based on the paving of 5 alleys. Wurl reported the seal coating would not be done until after Labor Day. Councilman Clymer made a motion to pay the bills as submitted by the Finance Department Seconded by Councilman Bergman. Roll call vote - Councilmen Clymer aye; Kuster aye; Bergman aye. Council request the parking be put on the agenda for the next regular meeting and also Council Comments would like the Mayor and Councilmen's Comments to be put back on the agenda. Councilman Kuster reported Wagner Par'k is a mess of litt~rl Administrator Wurl re- ported he has discussed this with-the Park Association and County CommisSioners asking for their recommendations. Wurl also reported plans for the parks will be submitted in the budget for Parks. Mayor Barnard questioned what is being done about the angle parking around Wagner Park previously approved by Council. Wurl reported he has been looking into lots to lease at a low cost. Council agreed to hold off on this and look at the entire picture at the next mee:ing. Council reported someone has been selling sandwiches out of an automobile. Administrat, Wurl to check out.
