Meeting was called by Mayor Robert Barnard, Councilmen Carl Bergman, Clyde Clymer, Werner
Kuster for the purpose of discussing the appeal of the Whitaker suit.
Mayor Robert Barnard called the meeting to order at 9;05 a.m. with Councilmen Carl Berg- Whitaker vs. Cit'
man, Werner Kuster, Clyde Clymer, City Attorney Albert Kern and City Administrator Leon of Aspen, Supreme
Wurl. Court Appeal
Attorney Kern reported that it is felt at this time that the City should consider dropping
the appeal in the Supreme Court on Civil Action No. 3900. This action has been set for
hearing this date.
Mayor Barnard reported that by dropping the appeal would not mean that the City had some
to an agreement with Whitaker, it would save the expenses of the appeal.
Gross Receipts Tax presently in effect, County Sales Tax would be in effect July 1st.
Councilman Kuster moved that in the best interests of the City of Aspen, we instruct Mr.
Roan to dismiss the Supreme Court appeal of the City in Civil Action No. 3900 - Whitaker
vs. City of Aspen. Seconded by Councilman Clymer.
Roll call vote Councimen Bergman aye; Kuster aye; Clymer aye.
Councilman Kuster moved to adjourn at 9:15 a.m., seconded by Councilman Bergman. All in
favor, meeting adjourned.
