Histori~ Preservation Commission review/approval. ~ ~: 'lJ ~, !:i ~{~ f!ft~ .. .'. ..,......., ~, MEMORANDUM To: Leslie Lamont, Planning Office From: Chuck Roth, Engineering Department (!'-f?- Date: July 12, 1995 Re: Cekovsky Condominiums Plat Amendment (Easterly 3 feet of Lot N and all of Lots 0, P, and Q, Block 16, Original Aspen Townsite) Having reviewed the above referenced application, and having made a site inspection, the Engineering Department has the following comments: 1. Legality of Original Condominiumization - The original plat was recorded in 1979 and lacks city approval certificates. It is not clear that it is a legal condominiumization. The original plat is deficient in various other information including but not limited to lack of designation of general and limited common elements. A copy of the first page of that plat is attached. 2. Method of Legitimizing Existing Conditions - It is not clear that the proposed plat amendment is the proper manner in which to legalize the situation. What is the status of the formerly condominiumized existing two two-story structures? Was ownership retained in a single name? Is this a duplex with an ADU? Can/should ADU's be condominiumized? If the Planning Office determines that the plat amendment is the proper form of legitimization, and if the original condominium was legal, then the Engineering Department will provide a more complete review of the plat. 3. Parking - If legalization is sought, part of the process should include meeting the parking requirements of one space per bedroom. Also, there are currently two parking spaces in the public right-of-way on Hallam Street that probably do not have City approval or permit. They should be removed prior to approving a plat amendment. 4. Encroachment - The plat amendment indicates an encroaching trash storage area. This should be relocated onto private property and redrawn on the plat after relocation. 5. Plat Details - (a) There is a utility pedestal that is not shown that is adjacent to the trash storage. (b) The final plat should indicate a five foot wide pedestrian usable space in the public right- of- way on Hallam Street. Before the continuing remodel, the property included two condominium unit.~ in the main house and a delached garage/studio unit on the alley. The studio unit was then made into an illegal living unit by a prior owner.
