Health Housing ~ Other: FILE STATUS AND LOCATION: Other ~ ~ MEMORANDUM TO: Bill Drueding, Zoning FROM: Leslie Lamont, Planner DATE: June 24, 1991 RE: Insubstantial Amendment to the Red Butte Subdivision Plat ------------------------------------------------------------------ ------------------------------------------------------------------ SUMMARY: The applicant seeks to amend the Red Butte Subdivision plat for Lots 2 and 3, Block 2 to adjust the lot lines. APPLICANT: Kiefer and Mary Mendenhall LOCATION: Lots 2 & 3, Block 2, Red Butte Subdivision ZONING: R-30 PROPOSAL: The Mendenhall's wish to adjust the property line of Lots 2 & 3 to eliminate a minor encroachment of the existing home on Lot 2 onto Lot 3. The adjustment is an exchange of 628 square feet which results in no net change in either lot size. Because the Mendenhall's own both lots this is not a Lot Line Adjustment to be reviewed by the Council but an insubstantial amendment to an approved plat. STAFF REVIEW: Pursuant to section 24-7-1006, an insubstantial amendment to an approved plat may be authorized by the planning Director provided it is a minor change to a plat which the Planning Director finds has no effect on the conditions and representation limiting the approved plat. FINDINGS: The adjustment to the lot line is necessary to correct an encroachment of the existing home onto Lot 3. The adjustment represents an exchange of 628 feet. The applicant has worked with both the Engineering Department and Planning Department to assure that the lot line adjustment does not render a non-conforming situation on either lot. At the request of staff, the applicant has included a note on the plat regarding a driveway easement to preserve adequate access for both lots and a note regarding Stream Margin Review has also been included for future development purposes on Lot 3. RECOMMENDATION: Staff recommends approval of the insubstantial plat amendment for Lots 2 & 3 Block 2, of the Red Butte SUbdivision with the following conditions: 1) Prior to recording the amended subdivision plat in the office of the Pitkin county clerk and recorder, the Engineering Department shall review and approve the plat; and .-., r-', 2) The plat shall be recorded within 180 days of approval by the Planning Director and Engineering Department.
