STIPULATION 6~i9 IlIftS_
WHEREAS, David M. Levy (hereinafter called "applicant")
is the owner of certain real property located in Pitkin County,
Colorado, more specifically described as:

Lots Q, Rand S of Block 55 of the City and Townsite Of
Aspen, and
WHEREAS, the applicant has applied to the City of Aspen for

a building permit for the purpose of constructing thereon a
dwelling unit with an additional apartment, which structure
is susceptible to condominiumization, and
WHEREAS, landowners have in the past recorded condomf.nfifm
plats with the Pitkin County Clerk and Recorder without obtaining
the prior approval of the Aspen City Council therefore, and in
contravention of the Municipal Code of the City of Aspen, and
WHEREAS, it is the desire of the City of Aspen and the
purpose of this Stipulation to place of record notice that, at
the present time, the laws of the City of Aspen provide that a
condominium interest cannot be conveyed with respect to the
real property hereinabove described without compliance with
the subdivision regulations of the City of Aspen.
NOW, THEREFORE, IT IS AGREED AND STIPULATED TO BY THE
APPLICANT that he will not convey any condominium interest
in or with respect to the real property hereinabove described
in contravention of or without full compliance with any sub-
division regulation applicable to condominium interests that
may be in effect at the time of transfer.
Applicant forther agrees that this Stipulation shall be,
upon issuance of a permit, made of record and be a covenant
running with the land and binding upon his heirs, suc_cessors
and assigns.
