From: Date: February 29,1996 Re: Ajax View - Northstar Commercial Condominiumization, Parcel ID No. 2735-124-39-770 This is a preliminary response to the application for condominiumization of the subject property. As we have discussed there are several technical questions regarding the degree of disclosure of surveying information that is required for this plat. It appears that the state code (Colorado Revised Statutes, CRS) requires a higher degree of disclosure than the requirements of the municipal code for subdivision exemptions. By state law the size of the condominiumization, fifteen units, places this application in the rules governing subdivisions although the city code does not make a size distinction for condominium conversions and the degree of disclosure. Since our meeting this morning with David Hoefer, I will review the CRS contained in the Colorado Common Interest Ownership Act, CCIOA, to determine if this is applicable and clarifies the required degree of disclosure. I expect to have additional comments on Tuesday, March 5, 1996, pertaining to this application. Mr. Dennis Green, attorney representing the applicants, contacted me earlier this week to inquire of the status of this application since the applicants desire to enter some time-sensitive contractual agreements regarding this property. He also stated that the required easement revisions for the electrical transformer had been completed by Chuck Roth, however our file shows that we are awaiting a response from Mr. Green with additional information about these easements. Until my additional comments on Tuesday, the applicant may be instructed to finalize the definition of all easements and encroacIunents on and about the property on the plat; finalize the exchange of easements for the electrical transformer; correct the wording and spelling of the several certificates, titles and descriptions on the plat; fully and properly identify all the utilities on and about the property; obtain a current (performed within the last thirty (30) days) title search; fully and properly label the physical features on and around the property, e.g. stairways, garbage enclosure, types of survey monuments found and set, etc.; establish a recognized basis of bearings and tie it to the property; establish a recognized true datum and tie it to the property; and provide the required clearances from the Environmental Health, Building Dept., Fire Dept. and City Water Dept. if these were not already provided in the application to your department. DRCMOI96.DOC 311196 ~ I"" MEMO - AJAX VIEW - NORTHSTAR cOMMERCIAL CONDOMINIUMIZATION .~ Apart from the several items identified in the immediately preceding paragraph, the following comments are preliminary and will be clarified next week. After reviewing the above referenced application and making a site visit I have the following comments: 1. See attached checklist from the preliminary review for general comments pertaining to the condominium map. Additional comments follow below for specific items. At least one (1) and possibly more progress reviews will be needed for this map based upon this preliminary submittal. 2. From preliminary checklist: A Provide Title Report written within 30 days of application date for review. Need legal description of each condo, i.e. perimeter B & D, floor & ceiling elevations. B. Correct wording of the Owners' and Surveyor's Certificates. Spatially separate the several certificates for differentiation. C. Need bearings & distances throughout drawing and for interior spaces of condos. Label property lines & R-O- W lines. Change font type to differentiate between "I" and "1". Number each sheet. Minimum permitted font size is to allow for clear reproduction from microfilm. D. Fully describe monuments found & set: preface license number with "PLS" ######; size ofre-bar, wi or wlo cap; types of caps found, aluminum, brass, plastic, etc.; set comer monument at northeast comer of property. E. Basis of bearings betw. two (2) City monuments or better, wi distance & bearing to property boundary. F. Structure not located within parcel by bearings & distances. G. Clearly label accessory structures & features on each story, e.g. stairways, window wells, walk ways to public sidewalks, trees in the public right-of-way, water valves, etc. H. Show original lot lines. L Bearings & distances of parking areas. Label parking areas at West end. Parking space numbering inconsistent wi condo numbering. J. Easements not shown. Dedicate easements for water and electrical to City of Aspen. Identify type(s) ofM.H.s, two (2), at north side of property. Easements may be required between these and public R-O- W depending upon purpose. Are there any aerial easements or encroachments of structures over other property? K. Remove encroachment of garbage shed from alley and properly monument comer. L. What do the demarcation lines indicate? Describe each, i.e. B & D. M. Separate Legend from~. Identify each abbreviation in legend used on map. Fully describe basis of bearings, those monuments, and benchmark used to define top & bottom elevations of each condo. Correct spelling in location description. Change name to fully represent properties being condominiumized. I suggest changing the name of the condominium to fully describe the buildings included and to differentiate it from similarly named properties (Ajax Condominiums), e.g. "Ajax View - Northstar Commercial Condominiums". 4. Vicinity Map is too small to clearly locate the subject property. Code requires minimum of 400 scale for vicinity maps. North arrow and scale not shown. 5. The legal descriptions of each condominium space must match the defining walls, floor and ceiling of the space. Adding, deleting or relocating walls that define the condominium spaces requires changing the legal descriptions of the affected units. Existing and proposed walls must to identified. Pennanent location of final walls must be established before acceptance. 6. Separate water meter and shut-off valves will be required for each building. Install and provide easement to City of Aspen. 7. Accurately identifY the garbage enclosure at the west end of the property. 8. In a separate letter, describe existing stonn drainage system and improvements to retain stonn waters within the property. Construct stonn detention system if not in existence. 9. The adjacent curb, gutters, sidewalks and driveways must be repaired to City standards prior to approval, if physical conditions warrant. Inspection of the concrete work by the City Engineering office will take place after the snow and ice have melted in the spring, 1996. To provide acceptance prior to the snowmelt, an agreement from the applicant must be given to the City that the applicant and successors will make any and all repairs identified before September 1, 1996 or reimburse the City the cost of the same. 10. Include name, address and phone number of applicant on application. Also include representative's name, title, address, work and fax telephone numbers. 11. Provide letters from each public or private utility serving the property stating sericeability of the property and confonnance with current standards including dedication of easements. Make all requested corrections requested by utilities to the satisfaction of each utility involved prior to submitting the final plat for review by this office. 12. Provide letters from the Building, Fire and Environmental Health Depts. stating that all buildings and facilities under the respective codes are acceptable or that all required corrections have been completed prior to submitting the final plat for review by this office. 13. Add the wording that, "All easements of record as indicated on title policy no. _, dated , have been shown hereon.", if this statement is not already present on the plat or map. 16. Work in the Public Rights-of-Way: Given the continuous problems of unapproved work and development in public rights-of-way adjacent to private property, we advise the applicant as follows: The applicant must obtain a written approval from the city community development department prior to beginning any work or development, including landscaping, within public rights-of-way. 17. Utilities - Any new surface utility needs for pedestals or other equipment must be installed on an easement provided by the applicant and not in the public right-of-way. 18. The iron fences along the south and west property lines encroach in the public rights-of- way. An encroachment permit needs to be completed to docwnent this feature and a notation needs to be added to the drawing to indicate that this is a permitted encroachment. 19. Due to the accwnulation of snow presently on the ground, we are unable to fully assess whether all utilities, encroachments, easements, and other required features are accurately represented on the plat. Therefore we will provide approval of the plat with the following conditions: A. That those details, dimensions, features and other information which may be added, amended, corrected or changed at this time, prior to the snow melt, are corrected on this plat before approval by the engineering department. B. That the applicant and its successor's provide a written agreement with the City to make any and all additional additions, amendments, corrections or changes deemed necessary by the engineering department and record an amended plat prior to July 1, 1996 or forfeit a $2,500 escrow account in the joint name of the city and applicant for completion and revision of the plat.
